Hello Vjs

 I came to USA on a K1 visa we got married and we filed for the AOS. they assigned a case number for our case and we waiting for the decision.

I am asking if the I-94 can be extended, I am struggling with the driving license and they denied me to apply for knowledge test based on the expiration date which is usually 90 days from entry.

I want to have a driving license an d to apply I need a valid non-expired I-94. is it possible to extended it.

I have read through USCIS website that they issue I-797 forms one of which is I-797A Issued to an applicant as a replacement Form I-94.is applicable to K1 visa holder who entered US and are pending AOS?

I also would love to hear recommendation from members on how to get over this issue and apply for driving license. please help with advises

Unfortunately that is the issue with K1 visas in some states. Some states will allow them to get a driver’s license without AOS and some won’t. You can’t get i94 extended. Has it been 90 since you’ve arrived? If your state requires you to have a non expired i94, and yours is expired, then unfortunately you are out of luck and will not be able to get your DL until you receive EAD card in the mail. Go back to the DMV and ask again what paperwork you need to get it.
