When filing for AOS for my husband, do i need to have my name changed right away so that it will reflect his last name when i file for affidavit of support( they i have to use my driver's license to verify identification) and also for my employment certificate?? or is it ok to have my maiden name on my employment certificate???Thanks,,,

yea u need to put already ur married name in ur AOS application to show the relationship of ur husband to you as a petitioner. im not sure about maiden name in your employment certificate. but for sure if you can prepare all your documents and I.D. in your married name the better.

That's an interesting question......we are waiting on our Certified Marriage Certificate to file the AOS. I have not changed my name yet on anything. I have already filled out all the AOS/EAD paperwork and used my maiden name everywhere. Never even occured to me to use my married name.....

You start with applying for AOS in your married name (this is assuming that you do want to change your name.) After that you can try and change your name in all other documents (you may have to wait for the Green card (or EAD)) as some offices are very strict about allowing your name change. That means Driver's license, SSN etc. Good Luck

I presume you are the USC and are wondering about the evidence you have to provide especially for the I-864? You may use your married name already. Even though most of your evidence (tax returns, old W-2s, etc) are in your maiden name. However, if you can already get the employment letter to be issued in your married name, that would be a very good evidence. Paystubs will probably take longer to be switched over to your married names as you first have to have the name on your SS card changed over. USCIS will understand and the maiden name/married name dilemma and the certified marriage certificate will help link both names.
