Yes, NVC informed me this morning that only USCIS can inform them of the filed 601a petition.  I called USCIS and was transferred to a “Level 2” agent who put a service request in for me.  I am to receive a “Notice of Action” in the mail in 2-3 weeks on USCIS’ DECISION as to whether or not they will fulfill my request. If approved, then they will notify the NVC of my petition (which I filed In September 2018).  Absolutely ridiculous. I have my NVC documents ready to be submitted, but certainly won’t do so until either I have notice from NVC that USCIS contacted them, or notice of a 601a approval.

Yes, you are right, it is ridiculous.

I submitted my documents to NVC on November 1st,

I attached copy of I797 notice,I applied I601A.

NVC accepted my DS260 and I864 already on November 19th. It was very quick.

And last week I got appointment to overseas consular interview. I called them and want to cancel the interview. NVC said, my case forwarded to US Consulate. So I have to contact with them...

And informed me USCIS still did not notice them from my waiver.

So my advice you wait little and send your documents to NVC later.

In our case, I hired an attorney 'coz I know waiver can be very complicated and we don't wanna risk it.  Our case took us 11 months in the making.  What's even stupid was, I remember we went to our atty and if I'm not mistaken we submitted our application together with the atty sometime in September 2016 and knowing that we have attorneys, so we didn't really pay attention.  I heard that it would only take like 3-6 months the most, but for some odd reason, we got the notice of receipt on January 18, 2017 and biometrics done in February, so we were happy thinking that wow, it is gonna be smooth sailing and we were just like, oh okay, give it 1-3 months and we will get the results.  But dang, the long waiting game started.  Like, I called and emailed or submitted request online 2 or 3x until the last one, they finally approved it.  I also called the NVC and they said that it was actually sent to Lee's Summit, MO and so that's why I joined this forum to see what's the current update.  Most of the people here earlier this year were through Nebraska and I see 3-6 months and they were approved already and in fact if you go to USCIS website, it says there 4-6 mos or 6-8 mos something like that and most of them get approval in 5-6 mos, rarely 8 mos max, but here I am 9 or 10 mos already with nothing.  When I called NVC, they said that LEE'S SUMMIT don't have timeline in their office, so I'm like, dang, screwed that they can just let us wait forever should they want to and so I kept bugging them until the last request I made, we finally got the approval and we got an email and we checked on our USCIS case status that it is updated there too instantly, no delay, whatsoever.  Only minor mistake, 'coz online says it was approved Dec. 4th but the I-797 Notice of Approval letter that we received that week says that the date of approval is DECEMBER 3, 2018 so there you have it, it took us almost 11 months, grrrrh.  As far as the DS-260, I also bugged my attorney to please file it while we're getting close to 8 month but they just filed it I think on our 9th or 10th month and we got a letter/notice from USCIS regarding the receipt I think, so I guess, our atty filed the DS-260 just in time for the expected approval, so I guess it was perfect timing.  The problem with filing DS-260 prematurely is that they will schedule you right away for the consular interview without even looking at your WAIVER approval 'coz that's not their job.  USCIS has to notify NVC, I think 'coz that's bureaucracy and that's how they work.  If you file the DS-260 you are gonna have a problem and things will get more complicated and costly.  So, my advice is, based on our experience, is to wait up until your waiver is approved or at a very latter date.  Now, we are just waiting for our consular interview and that one too, we don't have a way of knowing whether they are working on it or not.  My question here for others who have been in this situation is, how do you follow up?  Do I call NVC and ask them, hey, have you received our DS-260 or are we missing anything or is there any incomplete stuff?

So, we were just really patient and we were like okay, we waited this long, so let's just a little bit longer anyway we are not rushing things and we are just kinda going with the flow.  Good luck on us.

You have to submit DS260 online and send I864 with your financial and other documents by mail. I got answer after 3 weeks. I surprised, NVC answered quickly. Congratulations! Happy Holidays!

Yes. I called them and they said they need my proof of financial support and that's it. They also said 3 weeks. I will submit the I-864 that I just filled up. Question is, once it's completed, how far out is the schedule like?

Thanks a lot.

I filed 8/10, Biometric 9/11, and got email 11/7 that NVC got notice of my 601a waiver.

So it takes ~3 months for USCIS to inform NVC about 601a waiver.

Also, December is a nogo for processing at USCIS, based on noticing last year very little is processed in December by USCIS, while waiting for I130 approval (in the end took 10 months). USCIS as well as NVC are likely on holiday so less is processed.  Maybe add 1/2 month delay for December processing.

So may take up to ~3 1/2 months for USCIS to inform NVC about 601a waiver (delay in December processing)

Note - I'm no expert.  This is just my observation of patiently waiting for my USCIS petitions to get approved.  I pretty much sign off in December, as agonizing every day about getting approved just dulls my holiday spirit.

My 601a is at Potomac, with no stats on how long it takes for 601a processing yet.

Nebraska stats is 6.5 months to 8.5 months

I'll probably start checking more after 7 months.  Of course it's always in the back of my mind. It sucks that something could absolutely devastate your life and your at the mercy of the USCIS officer who adjudicates your case.

Clarebear101, hope NVC is notified soon about your case, and hope this helps! :)

Thanks!  Yep, we are only 3 months in, so you may well be right.  LIN Nebraska Center here :)  If I don't hear anything again by the end of February I'll call NVC again to see if they finally got notice of our 601a. Holding all my NVC docs till then.

I wish you and everyone the best of luck and patience.

Hello!

I finally received my approval notice today!!!!!!  It has a posted date of 12/19/18. Best X-mas present!

I filed 4/19/18 so it LITERALLY took 8 months. My case was in Nebraska, which I hear is much slower. Hopefully NVC works a little bit faster now.

Just wanted to give everyone an idea on the timeline as well as a little bit of hope because I know there are times it feels imposible to reach. Patience is key!! 😊😊

Best wishes to everyone!

Hello, I wanted to share my timeline.

I have received my approval notice on December 10, I have noticed that there are many people receiving their approvals =) in this month.

I submitted the waiver on April 26 2018

Fingerprints done on June 4

On September my attorney filed the 260 form, and a week after (September 27) asked for the police report.

November 19 NVC sent me an email saying that they are only waiting for the waiver to be approved.

December 10 received the approval notice.

December 19 NVC sent an email saying that Im in the queue awaiting an interview appointment. Does this mean that my case is closed like the other people say?

On the USCIS website the satatus hasn't change nor NVC. NVC website says that I need to follow the instructions nothing else.

/UPDATE:

We just received the Waiver approval: dated 12/21/2018

Hi, new to this thread, so glad I found it! It has been very helpful, as we were getting worried with our case taking so long.  We did not hire a lawyer up to this point, we filed with the help and advice from others who have gone through this process.

We applied and are waiting for my husbands i601a waiver approval.  Any advice on process going forward? We have not filed a DS-260 yet.

Our timeline:

Waiver Mailed to USCIS: April 9

Office: Nebraska Service Center

Received date: April 24

USCIS notified NVC: May 9

Biometrics letter received: June 15

Biometrics appt: July 3

Waiver Approved: Dec 21

Approval received: Dec 29
