Not from Honduras, but we are neighbors my spouse is from EL Salvador.

Before the NVC will schedule your interview, the NVC will need:

 

1) Completed and paid DS-260 (your IV application)

Hello I'm new to the discussion. My husband and I have been working with a lawyer and they filed all our paperwork for us. USCIS received our I-601A waiver April 5, 2018. My husband's biometrics appointment was May 22, 2018. We received an email with his interview appointment in Ciudad Juarez on April 28, 2018. His interview at Juarez was scheduled for June 25, 2018. When my husband went to his interview, twice in one day, they told him he's missing the I-601A waiver approval. I am confused, is this normal? Is this a mistake on NVC side? Could they schedule the interview before receiving the approved I-601A? We changed homes in the middle of our case and we updated the addresses, but we still thought it was possible they mailed the waiver to the old house, but even then, it should be logged in the systems at NVC and USCIS. Now my husband is in Mexico and I am in the US, I will be travelling to be with him this weekend. I'm just so dumbfounded as to how we got the interview without the approved waiver? When I call for information, they tell me my case is still processing....

Yes that is possible. I asked my attorney the same question because NVC was requesting a ds260. According to our attorney you have to wait for the i601a approval before filling that out because NVC will schedule the interview without the approval. You’re attorney should have known that you were still waiting on the approval and shouldnt have adviced you to leave the country.

Wow, sorry to hear that.   The attorney should've posponed your appointment until you received an approved 1-601A.   I think your attorney also should've advised for you not to go.

:-( yes, I regret going, we did not know to be honest. Every time I replay everything that happened I get so upset. We went back to the embassy for general information and to get an understanding of where we stand or what to do next. The lady who took care of us was very nice. She told us we just have to wait for the I-601A waiver to arrive in the mail, "it's the best thing he can do". She also said everything else seemed fine. With that I felt some relief, I am hoping it's just a matter of getting the approval in the mail so that we can go back to the embassy in Juarez and turn it in. My fear is they will require something else from us that we do not have. We are remaining positive and praying everyday that we get the waiver in the mail soon so that my husband can return home.

I’m so sorry. I can’t even imagine how difficult that must be. Did you talk to the attorney or ask why you weren’t given the correct information?

Sadly waiting is all that is left to do. I hope you get an approval soon and that you can soon be reunited w ur husband. Dont lose hope. Leave everything in God’s hands.

sorry for your case. When our lawyer sent ours we received a notification from nvc saying that they have received information from uscis about the i601a. Then at the time our lawyer sent in the documents to nvc, at this time we sent in a wrong  police record and they asked for the correct one. After nvc received it they wrote back everything was complete and that once they receive the approved letter, they will schedule is to honduras interview. So don't know your lawyer should've known because he had to notify bcc too about your i601a.

While extremely rare, cases like this have happened before.  This is an example of two large government agencies, the USCIS and the NVC, obviously not on the same page.  I'm as dumbfounded as you on why and how the NVC scheduled your husband's consulate interview without the clearance from the USCIS's approval of your I-601a waiver.  

 

While our I-601a was being processed, I was diligently working on the DS-260 and the I-864 and had both ready to mail to the NVC before the I601a waiver approved.  However, I didn't mail them until I had the waiver approval in hand.  

 

I'm confused on why your lawyer, aware that your interview was scheduled by the NVC, allowed you two to go to Juarez with the knowledge that the waiver had not been approved yet.

With immigration lawyer

Started Application of I-130 in September 2016 and September 2017 got approved

We waited for NVC to tell us that we can proceed with application and in January 2018, we started filing the I-601A and until now, no response yet of approval of the waiver.  We are on a same sex marriage.  I was wondering, so if this gets approved, what will be the next step and for how long will be the next process and how much?

 

Thanks guys and I do hope we all come out positive of this.

Just wanted to post an update.

There has been issues with our mail so we have not been receiving our notices in the mail. I've been having to call our attorney's office for updates.

i601a was mailed on 6/19

i601a received on 6/22

Biometric appt today 7/23

Now we wait.....

After your I-601a is approved, the USCIS will forward this information to the NVC.  

 

Your next step after the approval should be a complete the NVC's checklist requirements you should have received in your email.  Documents will include items such as your marriage certificate, tax returns, police certificate, etc etc.  If you haven't already obtained a police certificate, I would suggest you get started working on that now.  Once the NVC has received and reviewed all your documents and are satisfied, they will then send you an email stating they will schedule your consular interview.  A month or two after that email notification, you will receive another email by the NVC stating they have scheduled your interview, with date and time of the interview.  While waiting for your interview date, I suggest that you and your spouse do not make any major travel plans in the upcoming months leading into the interview date.  Consular interview dates are very difficult to change, and rescheduling an interview date can delay your case for as much as six months.     

 

Most of your fees are already paid since you needed to send the USCIS proof of payment of the IV application and the Affidavit of Support in order for them to process your I601a waiver.  The two biggest fees yet to come are the medical examination ($400-$600) and your Green Card ($220)...but those will be months from now depending on your I601a approval and the NVC scheduling your spouse's interview.
