Hi all, how do you determine the poverty guideline.  I understand the income part, but how do you determine the person in the household part?  For example, I plan to have a co sponsor, there are 3 other people in the household, including her, makes 4 total, but only 1 person is dependent on her.  So for the guideline, would this be rated at 4 people in the household or 2?

 

Also for the i134 affidavit, do you need to make 100% or 125% of the poverty guideline.  Please help clarify as I have read different information about this and nothing is stated in the i134 affidavit instructions.  Thanks.

I am the Petitioner, since I am using a co-sponsor, does me and my fiancee automatically count as a dependent?   

 

In my situation,  I am living abroad with my fiancee and can financially support us but I need a co-sponsor due to lack of tax forms.  My Co-sponsor doesn't make much and I they currently make above the poverty guideline based on their current situation, that I have stated above.  they only have 1 dependent.

Yes, you and your fiancée automatically counted as dependents.

 

 If i am not mistaken, You and your co-sponsor’s income will be merged.

For example there is only you(petitioner) and the beneficiary. You need to earn $20,575 annually. And so on and so forth.

Not everyone in the household is counted. Only your daughter/son or someone who is dependent in your income.

However many people they claim during tax season is how many people are dependent on them. 

 

No, you do not count as a dependent. Only the beneficiary. 

 

Some embassies won’t accept 100% at interview. They automatically want the financial sponsor to be at 125% since you have to apply for AOS when you get to the States. This is very embassy specific and you need to check if your embassy does this or not.

ok now I got it.  Last year I made over that amount abroad but I do not have the tax forms to prove it.  I'm currently doing my 1040 and 2555EZ form, will submit it to the IRS soon.  My fiancee interview is coming soon, and not sure what to do about the i134.  Can I show my 1040 and 2555EZ forms with proof of courier receipt, pay stubs and a letter from my employer? or should I still go with a co-sponsor and showing proof of my current financial status?

you are the primary sponsor, you will have to file an i134 regardless

 

now it is confusing on how many people are the joint sponsor's dependents

 

is he or she married? do they have children or parents as dependents?

 

the joint sponsor and the beneficiary are counted, plus any dependents, spouses, children or parents that they claim on their taxes

What i meant by these dependents are the number you should refer to to the poverty guidelines.

You should both have to fill(fill your I-134 and ask your co-sponsor to fill also) Prepare your pay stubs 6mos-1 year ago, employment. Better you are most prepared with the needed documents. Too much proof is better than sorry.
