Hello all,

 

I will file my I-751 in September, but have found out something that I have should have known a long while before I moved from my old address to my new address. 

 

Let me explain my situation, I have quite a problem here:

 

In January I just found out that I had to an AR-11 for every move that I made. I was initially living in Orange County with my wife. Then I moved to Temecula in 2017 of March with my wife and then around 2017 of September, my wife and I moved down to San Diego. According to immigration, for each move, my wife must file an AR-11 for each move within 10 days of the move. 

 

When I moved to Temecula, I did not file an AR-11 :(. It was only until January of 2018 that I did some reading that I had to file an AR-11 for each move. To rectify my situation the best we could, my wife filed the AR-11 in January stating our address change from Orange County to San Diego. USCIS sent an e-mail acknowledging the address change.  Yep I'm quite mad at myself for not knowing these procedures in the first place. 

 

Just now, I realized that I also have to file an I-865 for each move as well within 30 days (:angry: angry at myself for just finding about it now) and am in the process of filing it out now. On the I-865, it asks I have been living at my current address (San Diego) since when. 

 

Naturally I should say that I have been living at this address since September 2017 or should I fill in the date to match the day my wife submitted the AR-11?  

 

If I say September 2017, USCIS will find a discrepancy with my wife's AR-11. On the other hand if I say January 02, the date of my wife filing the AR-11, USCIS will find a discrepancy with my our 2017 September apartment lease which we plan to submit as our I-751 evidence packet. 

 

Which date should I use to answer that question on the I-865 form? 

 

If I choose to write 2017 September on my I-865 form, should I also write a letter to USCIS apologizing to them for the discrepancies on my wife's AR-11 and I-865 along with my submission of the I-865 form?  

 

When I file my I-751, should I also write another letter to USCIS apologizing to them for my failure to submit an AR11 and I-865 to document my move to Temecula and detailing all my moves for the years 2017 to 2018? I'm afraid that USCIS will use my wife's AR-11 and my I-865 against us in reviewing our I-751 application and doing a background check. 

 

Darn, I hope I'm not in serious, serious trouble with USCIS :unsure:. I know ignorance of the law is not an excuse, but I'm doing my best to rectify this situation.

Agreed  with this. We did moved twice too and my husband ( USC) filed late but he just used the recent address and everything is set. He still received a letter from uscis confirming they received it. No need to explain or letter of apology.Hope this helps.

I know the feeling, I was in the same situation 2 days ago. My wife filled the I865 over the weekend and I sent it Monday. I spoke to an avvo attorney twice who said no need for cover letter, just send the filled out I865.
