Hello,

 

My wife is on a two conditional residency and my brother is a joint sponsor due to my lack of job or income when coming back to the USA.

I am trying to get Medicaid insurance for myself and they want me to remove my joint sponsor so my total income will be less.

Will this affect my wife's status in any way if I remove my brother's joint sponsorship?  We are currently living in the US now.

  1. As the petitioner and financial sponsor, you will not only need to show that your income and assets are high enough to avoid the immigrant becoming a public charge,
  2. this is for renewing green card   
  3. how do you intend to show the needed 125% poverty guidelines later if you yourself are going on medicaid (that is a low low income )
  4. how are you paying for her medical insurance as she can not receive assistance for 5 years
  5. looking for trouble in future with immigration

Join sponsors can’t be removed the only way the contract ends are if your husband become citizens or after 5 years of permanent residence

05-18-2022: Filed N-400 online. Received online NOA and Biometrics re-use.

Thank you all for the quick responses.  I agreed that removing the joint sponsor and me getting on Medicaid are bad ideas.

So I am assuming that she gets health insurance through tax credit is also a red flag when it comes to renewing her green card status?

They told me it considers both incomes, me (the husband) and the joint sponsor (my brother). That's why they want me to remove my joint sponsor so the income won't be so high in order to qualify for Medicaid.

Just curious to me because it was my understanding that the joint sponsor is only financially responsible for the immigrant (not the spouse). I'm probably wrong though.

There are Immigration rules

 

There are Medicaid rules

 

There are a couple of areas where Immigration relates to Medicaid but generally there are seperate issues.

Would it be okay if she receives a tax credit for health insurance?  I can forgo Medicaid or assisted health insurance.

This makes no sense.  How would they even know about your I-864?  I'm so confused here.

 

You, the USC petitioner can get medicaid without it impacting any immigration.

Your spouse, the LPR, can get obamacare without issue.

 

We've done both in the past and had a joint sponsor.  Lots of people have done this.

 

Sounds like you need to figure what is going on with your county's social services department who is approving medicaid apps.

At this moment, your wife totally qualifies for ACA insurance and it can't be used against her that she did for any future immigration benefit. Trump said something about wanting to change that but he hasn't and has probably forgotten about it by now.

I don't know how they know, but the county knows I have a joint sponsor for my wife.  They told me the combined income of me and my brother will be used for income eligibility for Medicaid.  I am waiting for a job offer so I might not need the Medicaid.  If I don't get the job then I will talk to them again and will update it here.  We are currently living in Colorado.

No, I assumed the same thing.

In fact, my good friend and her fiancé were married one year ago. She is on public assistance - they are married - but he is not!

They has a surprise pregnancy the month he immigrated here and has a VERY rough pregnancy. She couldn't work.

 

Anyhow, I don't think the joint sponsorship effects you applying for Medicaid.
