I know somebody who migrated to the US as a Health Care Professional using a H1b, now the requirement of having a degree and and the job requiring a degree is unusual in Nursing, but she was able to do it.

Also you have the Lottery to contend with.

MIL could sponsor a sibling, but this is a longer wait than is likely practical. There might be other opportunities depending  on the specific qualifications of the Aunt. So what are they?

What sort of time period are you looking at?

Seems to me that this is a work visa issue so will ask one of our friendly Mods to move to the correct forum.

OP wants to get the help here faster than the sibling category petition would allow; thread is in the bringing family members of USC forum. Work visa is a possibility depending on aunt's qualification, but cannot be sponsored by an individual. In my educated guess, caring in the Pl is an apt option that takes care of close family and language barriers.

I-751 journey

10/16/2017.......... ROC package mailed

10/18/2017.......... I-751 package received VSC

10/19/2017.......... I-797 NOA date

10/30/2017.......... Notice received in mail

10/30/2017.......... Check cashed

11/02/2017.......... Conditional GC expired

11/22/2017.......... Biometrics completed

  xx/xx/xxxx.......... waiting waiting waiting

I am not aware of any restriction not allowing individuals to sponsor work visa's.

Anyway I see a lot of assumptions, need clarity to make sensible comments.

Time line is obviously important.

geowrian - thanks.  i will probably need a crafty immigration lawyer to help me with this.

Crafty or not a lawyer will not be able to help you with this.    Too bad we don't live near you guys.  My wife is Cebuano.  Speaks Ilocano, Tagalog, Cebuano, Ilongo and English.   She visits patients homes on a daily basis providing hospice care.  She is loved be all of her patients.  In fact, many of the older ones will only accept my wife taking care of them.  I'm sure you can find someone who can earn your parents trust.  You have to keep trying.  There are so many wonderful Filipino caregivers in the US.

That likely is not going to work. While it is possible to get a B-2 for a domestic worker, there are very strict conditions on this and it sounds like they won't qualify. Furthermore, having them be a family member is a big conflict of interest. It's just not happening, sorry. You, as an individual, cannot petition for a worker either.

I guess there is nothing in particular preventing an individual from doing so...but it's simply not practical. The individual could be the employer, but I didn't think it was relevant to the situation. That's more for an individual who operates a business.

How many work visas (other than seasonal agricultural ones and similar) are granted to people for whom sufficient existing candidates are available in the US, though? OP hasn’t even confirmed whether or not the aunt has any qualifications other than being a family member. If that’s the only requirement, OP and spouse qualify and are already able to work and live in US.

OP has not mentioned I believe her skill set.

No, even when asked, so I did make an inference on that one.

Well so many times when this comes up the driving factor is cost, and as soon as they realise that no you can bot bring some one over and pay them their local wage interest seems to wane.

Here the OP has a specific need and cost does not seem an issue so maybe different answer. Not a cheap process which is why I assume many who ask go away disappointed.

Well, hindsight is a wonderful thing. Might be useful for others to hear all about this who are keen to get that I-130 for their parents in the mail before the ink's dry on their citizenship certificate.

This is the reality of immigrating later in life - language problems, feeling ostracized, not feeling comfortable around locals, aside from the myriad of health issues.

I think in this case it may have been the other way around, Mother naturalised decades ago.

Both my husband and I were born here and lucky for us we have are both professionals with a successful business.  I hate to disappoint you but my parents met here in the U.S.  I'm trying really hard to be open and sensitive to all of you who are trying to get legalized here in my country but I'm feeling less supportive and now hope that the laws regarding immigration gets tougher so you all find it more difficult to get legalized here or better yet be returned to your country.  My aunt has money she can choose to start her own business here and stay legally if needed be.  JFH you might want to take your advice when the time comes around and you have to file for citizenship OR hopefully you'll get denied.

Well if your Aunt has money then have a look at the EB5, sadly we often only see a small part of the picture and have to fill in the rest according to common norms.

Wow, that’s rather petty and mean. As far as I know everyone answering here is perfectly “legal”, by the way.  If the laws get tougher, it will hurt your aunt’s chances way more than us, careful what you wish for as they say...

Why didn’t you mention your aunt has money to start her own business? Then it’s easy, EB5 visa. Not sure if she’ll have time to look after your mom, but you can all figure that out once she’s here.
