We weren’t ready when she lived in the states we had only been dating for 6 months and when I met her she was committed to leaving and finishing school, reuniting with her family our relationship grew and grew over that time and the years she left. She is finishing up school so we started the process of the K1 Visa.. we were pretty sure she’d need a 601 waiver that’s why we’re in shock they said she didn’t.. she still needs to fix medical and the guy said he would issue the visa after that. Went as far as asking if she wants to pick it up when it is ready or get it mailed or even get it mailed to a consulate closer to where she lives. So I won’t celebrate until they actually mail her passport to her with the visa because I’m still in shock about it all.. I am also worried about if they do give her the visa and they did make a mistake if will have problems at her POE.

On the plus side, an I-601 for AOS is much easier IMO. And you could be together in the meantime.

It's just surprising that they insist there was no overstay warranting a bar. I'm curious to see what happens.

Yea I even spoke the Lizz Cannon today because I know she consulta for free .. she was taken back as well but told me I’d like th CO said after you fix the medical you will get the visa and they send it.. that she should absolutely go ahead and most likely will get thru.. and echoed what you Californiansunset said there may be an issue at AOS for green card but at that point she is with me in the states and can file there.

Yes and during AOS the IOs tend to be way more lenient than the COs so having the immigration issues then will be way less of a hassle.
