Weed & Failing Medical (Jamaica)

Hello All,

I have a question about weed and if it may or may not impact the results of a medical exam. I've searched google up and down to see if i can secure an answer for this but there isn't a black and white answer.

Jamaica  made weed legal in 2016. Although one of the best things that attract tourist to Jamaica is weed.(Immigration, government, the world knows)- and of course ALOT of states in the USA has decriminalized weed. My Fiance smokes weed, interview is this month. Will the use of weed impact the medical exam results in a negative way and may burn him from getting his visa. What do you guys think? If there is anyone doing a K1 For Jamaica i would love to hear thoughts.

Some states have legalized it, either for recreational use or medicinal use.  A word to the wise...   Since his interview and medical is by and for "federal" and not state,   pot may be in issue.  "Federal" law it is illegal.  I have read articles recently where Canadians (where it is normally legal) and entering a State in the US where it is legal,  was question by Federal Immigration if "they ever smoked marijuana... a yes answer (although legal in Canada and the state they are going to) was denied entry in to the US (where as a whole, it illegal).  Unless they do a hair test,  he should not partake and clean up for a urine test.

Yes, the immigration view on marijuana is that it is illegal and serious enough to cause a one year ban.   No one has mentioned getting a free pass.

Normally it is a year delay for failing the medical.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yup, 1 year ban is the typical result for somebody who has recently used pot. They may require testing during and/or after that period to ensure he remains clean.

Won't really matter as they will ask about drug use anyway. Plus there can be physical signs of past usage, like in Jamaica I've been told they will check your hands since many people "grind" it in their hands and it leaves marks as a result (oh, the things you learn on VJ...).

Just always be honest when asked questions. Think if you answer "No" to prior use and then they find out you have. Way worse than just being upfront about it to begin with.

This is a common question on here. Many people think that because marijuana use is legal in their country or in some states in the US that it won't effect their medical. Unfortunately, that is not the case.

 

If he fails the medical. It is not the end of the world. He will likely be given a one year ban where he would have to stay clean (his proof would be periodic drug testing). After the year is up, he can continue with the case.

Timeline

Marijuana stays in your system for a long time, you should tell them yes, let him stop doing and clean himself up and then try again, they WILL find out, it's so many other ways now than just a urine test, so lying about it will cause you major consequences if they find out.

So if I used cannabis in 19 85 I should tell them that? I mean I won't be in that position of being interviewed and ask if I use cannabis, I mean living on Jamaica they are probably assuming you do use cannabis.

Not sure about PI and I do not remember being asked but certainly a common question for some Consulate medicals.

If asked (not all places ask), then yes you would tell them. They may or may not want follow-up testing or an evaluation, and it may or may not result in a temporary ban (they do have discretion).

Minor usage that long ago likely would not be an issue. Somebody trying it as a kid probably would not be an issue (I've seen some pass fine with this, and not others). Somebody who fairly recently used it recreationally would likely have a ban to confirm they are no longer an active user.
