Hi, please can someone help me.  I need to find out some way if my J1 visa which I filed in 2011 has that 2 year residency thing attached to it as there is no mention of it on the actual visa in my passport.  I was a camp counsellor in the USA.

 

Thanks in advance to anyone who can help me figure this out.

"A J nonimmigrant camp counselor may be subject to the two-year home residency requirement in section 212(e) of the Immigration and Nationality Act (INA) if his or her program is (see 9 FAM 402.5-6(L)(1):

  • Financed (in whole or in part, directly or indirectly) by a U.S. Government agency or by the foreign national's country of nationality or last legal permanent residence; or
  • The alien at the time of last acquiring J nonimmigrant status was a national or resident of a country designated as requiring the services of persons engaged in the field of specialized knowledge or skill in the 2009 Exchange Visitor Skills List, 1984 Exchange Visitor Skills List, or 1972 Exchange Visitor Skills List."

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Your DS-2019 will say whether Section 212(e) applies.

Look at your DS-2019 and the stamp on your visa.

 

If the DS-2019 in the bottom left checked "Subject to the 2 year residency requirement based on...", then you are. It is important which category is selected. 

 

The J1 stamp could say "subject to 212(e)". 

 

But I doubt you are subject as a camp counselor, unless you got some funding from your government or the US government.
