I have seen that in some cases involvement of a senator or a congress person gets answers from unresponsive posts...my friend's situation is one that may need such move...after two interviews in NY her case have been send out to California Processing Center without any explanation as to what is happening and what is the reasoning behind this move...if any of you can provide some info regarding congressional assistance I would appreciate...

My understanding is that they can do nothing to influence your case in any way. They can inquire but have no direct impact on whatever decission that is made or not made.

but they can possibly find out why it was moved, if its being worked on currently, and get them to hurry up about it.

We had to involve a state senator two or three times now since we started this whole mess. Every time they were able to get our file found (they keep losing things :P ) and get it back on track. All we had to do was call the Senator's office and speak with the immigration liason. And one time my husband spoke directly to the Senator herself (Dole, NC). Calls to Senator Edwards (at the time) went completely unanswered.

It shouldn't happen, but be prepared that if the USC half of the equation is a registered voter of one particular party, the other party may not respond. That's what happened in our case, and a few others that I know of.

Cases are sent to the california service center because your case meets the criteria for approval or denial of your AOS without an additional interview. Moreover, USCIS will not transfer your case to the california service center unless it believes, based on initial analysis, that your petition is likely to be approved. Therefore, it xfrs the case to the CSC where it can be further analyzed and "fast-tracked" for approval. End Point - it's a good thing your case was transferred to the CSC! :thumbs: Now just sit back and relax.

In regards to congressional assistance, contact information for your congressman can be found here. Keep in mind that all your congressman / senator can do is send in a request for status on your case. They can not expidite the processing of a case or appeal to USCIS on your behalf. An example of when you should look at reaching out to your senator / congressman is to get a case "moving" after long periods of inactivity.

Thank you all very much...I hope that it will all work out in a positive as my friend's husband is teminally ill and they are just worried why things take so much time...but I know that the immigration process is exhausting as I am going thru it myself...

Terminally ILL? sounds fishy. Anyways I don't think they would have a problem if he passes away.

unless ofcourse the diagnosis was made after the marriage.

Though I agree that from a USCIS point of view this would seem "fishy" because to them almost everything is.

Marrying a guy terminally Ill, then worrying about your papers so much to get the congressman involved before he dies......thats the fishy part.

The OP never mentioned if the couple were both here in the US together. Perhaps they just want the papers filed so that they can be together without worry in whatever time he has left. To me that doesn't sound fishy, it sounds perfectly reasonable. And even if they ARE in the US together, maybe they don't want the time he has left to be dealing with USCIS and all their craziness.

6/19/2002- Met Online

11/10/2002- Met in person for the first time at Buffalo International Airport we spend a blissful but all too short week together.

2/23/03- David proposes on the beach in Melbourne Florida at sunrise during his second visit.

9/26/03- After much talk with USCIS we decide to go ahead and get married during David's third visit, with David planning on returning to Ireland the following week.

9/30/03- Phone USCIS to ask questions on filling out paper work and USCIS officer informs us that if David is already here he doesn't need to leave. After numerous calls to the Irish Embassy and two more calls to USCIS to confirm, we decide he will stay.

12/02/03- Petition for AOS recieved

10/8/04- EAD FINALLY arrives

11/10/2004- Our Son Colin Michael Kieran born two years to the minute after our first face to face meeting!

1/26/06- Recieved interview appointment letter.

3/09/06- AOS approved! David is a permanent resident with stamp in passport.

4/4/06- Green card arrives. We are now free to travel back to Ireland so David can see his family for the first time in more than two years.

Well, the OP *did* say there have already been 2 interviews.

You might not be aware that there are many NYC cases that are pending 3+ years, lost forever in a quagmire.

Or, that if the USC sponsor dies before she gets her AOS complete that she's out on the streets, so to speak, and will have no legal basis left to stay in the US? Yeah, I know, if it's only for love then it shouldn't matter that she sold up, moved to the US and has lived here for 3+ years--out with her!

Now, none of us know if that is the case or not, but give her the benefit of the doubt. Those hanging NYC cases are an injustice. I hope they get their approval in the mail from California very soon.
