Thank your for the Information. My Esta was not denied in first place. My esta was denied after he has the case with the FBI. My B2 Visa was not denied. It was under administrationg Process. I cancelled the Process because I needed my Passport.

My K1 Visa is at the embassy in Germany under administrating process. Thats why I am asking shall I email them to cancel my visa.

The FBI wants certain Information from him. They told him if you we dont get the Information the Visa will be never issued. The case with the FBI started after the NVC Step.

No offense but I don’t buy this. You need to get hard facts on why you’re under AP for so long. And you’re only gonna get that at the embassy.

Listen I am from Germany. I travelled before in the USA for a couple times. I never had any Problems. I could travel with Esta no Problem.

We applied for K1 Visa. Everything was okay. Then I checked the Status of my Esta . The Status was changed from "Authorized to Travel" to "Authorized not to Travel" . So I applied for a B2 Visa to see whats the Problems is. At the interview everything is fine but I am under administrating process. During this time my fiance visited me and the FBI came to his house. Then I find out the he met Person that is watched from the FBI. So automatically the FBI is investigating him as well. This caused the Problems. The FBI told him we Need to talk to this Person you know. So basically he has a case with the FBI. This happened much more later. Since he started to have the case with FBI. All my Status was changed. Before I never had any Problems.

I agree that we are not getting the full story. This is not adding up and this is unusual.

 

Is your fiance from or have visited someone from a country on the banned list?

Sorry but I think you have a problem with your story. Whatever that may be whatever you want to do cancel or not end relationship or not that’s all you. Like I said before you need to contact the embassy and be persistent to speak with someone who can give you more accurate information on your case.

What Kind of Problem do you have?  I am from Germany. I travelled before in the USA before I met my fiance as well I met my fiance. We decide to get married and we applied for a K1 Visa. We had RFE. He send it and the K1 Visa was approved. At this time he were talking with a Person who is being watched from the FBI (I found these later out.)

Between the RFE-Process I wanted to visit him and realized that my Status of my ESTA was changed "Authorized to travel" to "Authorized not to travel." So I applied for a B2 Visa and I went to the interview and they asked me only questions about my Fiance. They told my Visa is under Administrating process. After a while I cancelled the Process because I needed my Passport. Then my K1 Visa was approved. So I made an appointment at Germany embassy and it was the same I am on administrating Process. It  did not make any sense for me.  Then he told that he knows someone who is being watched from the FBI and automatically they investigating him as well. This Person were living for a time in my fiances house. I dont know if this Person is still living there. The FBI told him that i Would not get my Visa until they solved the Problem. This is all what my fiance told me.

Ok dude I don’t have a problem you asked a question on this forum because you wanted to hear people’s opinion. That’s what I gave you. I think your story is full of holes and I don’t buy it. 

 

First of all, you said your visa was approved. Wrong. Your petition to request a visa was approved. Second of all, when someone applies for an immigrant visa whichever that may be they have immigration intent and everything they apply while that process is up is gonna be hard to get approved unless you can convince them in paper not just by mouth that you will go back to your home country. The minute you filed a K1 petition, you’re automatically given a red flag for all non immigrant visas. My best guess is you got denied for both esta and B2 because you have an immigrant visa application in process. It’s as simple as that. Now being on AP for so long isn’t normal but it isn’t unheard of. Some people go under AP for years. 

 

If you wish to end your relationship and cancel the process that’s all your decision. All I’m saying is you need to contact the embassy for full on facts.

So all you want is to get your passport back and forget about the K1 visa, correct? I'd start with emailing the embassy and asking them to cancel the visa and return the passport. 

 

As for clearing your name, there will always be a record of your visa petitions, including the K1 with the petitioner's info, but if the problem really does sit with him (FBI issues....ect), then your future visa petitions should not be in any danger of being denied unless you too are involved in this 'FBI case' or you don't meet the visa requirements. 

 

You may also want to find out why your ESTA status changed...

all in all, if you want your passport back you need to visit the us embassy, email, or call them. let them know you want to cancel everything and you need your passport back. I can't say that your esta will ever be active again, but all you can do is ask them about that as well. If you want away from your fiance and end things, IMO that would be the best if he is in fact involved with the FBI, you need to get as far away as possible. However fact is all that has happened, ETA, B2, K1 it is all in your perm file at the US embassy in Germany, unless you hire a lawyer you will likely have problem ever coming to visit the USA, since you have now been attached and linked to someone that is now possibly on the FBI radar.

Occam's razor : when presented with competing hypothetical answers to a problem, one should select the one that makes the fewest assumptions.

 

ESTA was amanded a couple of years ago, I think,  to tighten security.

 

I really doubt that you are caught in the plot line of Bruce Willis thriller. 

 

Like so many in this forum, myself included, your case is just undergoing a routine administrative processing. Some cases can take many months to get resolved. 

 

Are you a dual national? Were you born in another country?
