Filing I-102 with I-485.

Hellos,

 

Does anyone know if one could file I-102 with their I-485 application? If so, then would both be filed at the same address as one package at the I-485 filing address?

 

Does the address for filing I-485 vary on the underlying category for filing the I-485, or is it the same.

 

Is there such a thing as premium processing for I-485?

 

Can anyone tell me how long it took after they've filed their I-485 to see an acknowledgement of their application being filed via UCSIS online case update?

 

I plan to file I-765, I-102, and all the supplements  (redudant copies, as different applications might require the same supplemental documents) all together.

Proof of inspection and/or status is required with the I-485 filing. Can you lookup your I-94 online (https://i94.cbp.dhs.gov/I94/)? If not, you can either include the I-102 with the I-485 packet, or file the I-102 first and include the NOA1 with your I-485. That said, I'm not sure if it will impact your timeline or not (i.e. I didn't think they proceed with adjudication of the I-485 or I-765 and such without proof of inspection).

 

Yes, the address for the I-485 varies. See the addresses here: https://www.uscis.gov/i-485-addresses. That said, most people fall into the Chicago lockbox category. Please fill in your timeline to assist with specifics.

 

There's no such thing as premium processing for AOS.

 

A NOA1 is typically received within 10 business days, but can take a month or so in some cases.

I do have a copy of the I-94. I also have a copy of the FOIA. Still I understand I will need originals? Is it true there are interviews regardless of what underlying category you are submitting the I-485 on?

Then I'm not sure why you need an I-102...? The I-102's purpose is to get a copy of the I-94. If you have one already, you're fine. A printout from the website is sufficient, too.

 

There are interview waivers available in some circumstances, but they are not available to most cases. For instance, if you are doing family-based AOS as a spouse of an LPR or USC from a tourist, student, or work visa, then you will definitely have an interview. Whereas if you entered on a K-1 visa, you might have an interview. Please fill in your timeline for more specific information.

The requirement from the I-485 is stated as follows. Note that it refers to copies of the I-94.

"Inspection and Admission or Inspection and Parole

Unless applying under INA section 245(i), most Form I-485 applicants must submit photocopies of documentation showing they were inspected by an immigration officer and either admitted or paroled into the United States.

...

This evidence must relate to your most recent arrival into the United States. Submit copies of the following documents, if available:

A. Passport page with admission or parole stamp (issued by a U.S. immigration officer);

B. Passport page with nonimmigrant visa; and

C. Form I-94 Arrival-Departure Record (See Form I-94 Arrival-Departure Record in the General Instructions section of these Instructions)."
