Nebraska and Texas do not process K-1's anymore so those are all forwarded to California. So, in the great wisdom of USCIS 3/4 of the k-1 petitions go to Cali and 1/4 to Vermont.

I don't see why they would. I'm sure they all just get shuffled into boxes as they're received.

Well, it's officially been one month since USCIS says they mailed my paper NOA1 (I-797) and still haven't gotten it in the mail.

I called, and was told now we have to give it 45 days from when they say they mailed something till you should call if you haven't gotten it yet. Uh huh. So, I will be back on the phone June 14th if I still haven't gotten it.

I also asked if she could check my address to be sure it's correct. She said she didn't have my personal case info in front her and when I asked who I could ask, she hmm'd and haw'd and I was like, 'that's fine, I'll delve deeper into that when I call after the 45 days if I didn't get the NOA1 yet". She sounded relieved.

Sounds like the customer service people only have the info that's available to you online in front of them.

So, just a heads up, 45 days for paperwork to possibly arrive. They should probably change their website which SPECIFICALLY says call after 30 days if you haven't gotten something they said they sent...

How really irritating, you know, if she really doesn't know then she should just say so and not try to 'sound like she can help' when she can't. It makes things much easier for everyone that way.

Hopefully your NOA1 will be arriving soon. I'll keep my fingers crossed for you guys. Hang in there! We will get through this!

Hello!

I sent the 129F on May 15th

It was received on May 18th

Check cashed on May 21st

Still have not received the NOA1 in the mail

As I understand, it isn't that big of a deal if you don't receive the actual NOA1 in the mail right away since they have already received the package. As I understand, I already have an NOA date - May 18th since that was the day it was received. Am I right ?

Emily - It can take up to 4 weeks (worst case scenario) for them to "officially" receive your paperwork. Mine was received after 20 days, but I've seen other people take 25 days or so. So don't panic just yet!

And be careful calling your attorney. You were not stupid in any way getting any attorney; if I had the money, I would have myself to be sure everything was being done correctly. But, they can charge you each time you call. It can count as a "consulation". Each attorney and office is different though, so you may not be. Just a heads up though, you might be adding to your bill with your attorney!

It's easy to say "just wait" but believe me I know that's very hard at this stage. But unfortunately, that's what you're going to have to do. If they haven't received it after 30 days, you can call USCIS directly. Keep an eye out for your cashed check, that's usually the first "notification" we get that the package was officially checked in. However, you are in a good position by going through an attorney: if for some reason they don't get your package, I'm sure your attorney has a complete and perfect copy they can resend.

Olijj - Yep! You got it exactly right. I still haven't received my NOA1, and that was supposedly mailed May 1st. Someone else posted a copy of it in this topic, and you can see that it doesn't tell you much that you don't already know. However, still like to have it for when Adam visits, so he can present it to the Border Patrol that we have a case pending.

It seems like the only people who are consistently getting the paper NOA1 are Vermont filers. Everyone else seems to have a 25% chance of actually getting the letter! Hmm...

Oh well.

Congrats to everyone! We're on our way now! Come on early August!!!!

My checked was also cashed on 06-01-07. They said the NOA1 was sent out 05-29-07. Hopefully I'll get it sometime next week. Let the wait begins.

Well, let's see, they cashed my check...23 or 24 days after I mailed the package, so I would think about calling USCIS soon if they still haven't cashed the check around that time frame. I ended up calling them yesterday because it was two days shy of a month from me sending it, and no word, and they were very helpful. They did ask if my check had been cashed (which it had at that point but did not have the WAC# like it seems it should have). They asked for my name, date of birth, type of petition, when mailed and where, blah blah, questions you should be able to answer easily, and were able to give me my receipt number over the phone. From there, I registered for case status updates, that's how I could tell my case was received May 1st. The person I spoke with told me that as well. My NOA1 was supposedly mailed May 1st as well, but I have yet to receive it.

I don't think there's any harm in calling. You know your package was received, I hear they assign your number, cash your check, and send your NOA1 pretty much immediately upon arrival. I myself work for the government, (enforcing domestic court orders - i.e. divorce files, we have 50,000 open files right now) so I can definitely say it's not unheard of for things to be received and then never be seen again. Sometimes things get accidently put in someone else's file or accidently marked as resolved even though it wasn't, etc. Human errors happen. Hopefully it's not the case for you, but I say better safe than sorry.

Has your check been cashed yet? If it has, you can get the case number from the back of it and check your case status online.

Think you should contact your bank to see if they cashed your check, (do you have online banking?) if they have cashed your check, your case number will be printed on the back. Keep us posted and let us know how it goes.
