My K-1 packet was recieved at TSC 05/22/07 and sent to California to be processed. Received NOA-1 via snail mail. According to the website, nothing has been done with my packet since it was received 96 days ago. No touches or anything?! How much longer am I going to have to wait for something? Since my paperwork was received, the estimated processing times have changed 3 times and I am afraid they will change again before my papers are even looked at. With my luck, they will hold my paperwork for several more months and then spring an RFE on me, making the process even more unbearable!!!

I think we are all in the same boat---check out the May filer threads...a few have been approved, but the majority of us are still waiting. I share the same NOA1 date as you--May 24--and it does border on the unbearable to have to wait for such a long time!! I did call my lawyer who is helping us through this process, and they are saying that I should have to wait no longer than 3 more weeks for the NOA2. So that is a little light at the end of the tunnel :) Hang in there...us May filers should all be getting some good news really soon!

Since we all are going to be approved very very very soon, I just have a couple questions on some documents that I will have to bring to the interview with me.

Pat had sent me a copy of his last 3 years tax returns, I-134 affidavit of support, this paper Affidavit of meeting of fiance/fiancee and Bona Fide Intention to Marry Fiance/Fiancee notarized and that's all I have. He haven't sent me any pay stubbs since he does direct deposit but he did send two or three to our lawyer and I guess that was for USCIS. One more thing, he couldn't get letter of employer since he works for New York City and doesn't have any idea where to get this, so we asked our lawyer and he said that with the pay stubbs and tax returns was fine.

My question is....Do I really need to bring a letter of employer to the interview....????

And as far as the pay stubbs I told him to find at least 2 pays stubbs so I can take them to the interview because he gave the original ones he found (I think) to the lawyer....

Btw, we also have tons of pics together (already printed them), proof of mail that I used to get when we were living together in N.Y, don't have my airline tickets because I never thought we were going to do this process but I think that with my passport is more than enough...or not? I have printed his airline ticket when he came to visit me, hotel bills under our names.

E-mails....well, that's then thing..it seems that everybody takes e-mails but to tell you the truth....I was the one who created him an email account that he almost never use, when I met him and found out he didn't have an email I thought he was from another planet, haha, anyways, so no emails (not a computer guy) :blush: and we talk on the phone but use calling cards and I never saved one, neither he did. Letters....well...not one, I think I sent him one for his birthday last year, not sure (not really happy times)

As I said before, we never knew we were going to do this process...

Any help????

Hi Mirla,

I suppose someone with more experience should address this question. You might try posting it in the K-1 forum under it's own thread.

Pat should be able to get copies of his pay stubs to send to you. He can just ask someone in the Human Resources Dept. to do this for him. Does he not have a manager who could write a letter for him? Chances are you won't need it, but I'd certainly rather have something than nothing, just in case. I would think the evidence you DO have should suffice. The hotel receipts, photos, etc. I can't imagine you'd need much more than what you already have. It sounds to me like you've got what you need, although I would ask Pat to get those pay stubs from Human Resources OR... save his next few to send to you as you all still have a little bit longer before the interview. Also see if he can get a manager to sign a brief letter stating how long he's worked there and that his position is permanent. It doesn't have to be lengthy, it just has to have those elements, showing permanent employment.

10/30: NVC SENDS CASE TO LONDON CONSULATE

11/1: Consulate receives case in London AND sends out Packet 3.

11/6: Sent Packet 3 to Consulate (we'd downloaded the forms on VJ and had them completed already)

11/22: Appointment for Medical.

01/08: Interview scheduled for 10 a.m. APPROVED!!!

02/01/08: Stephen comes to America!!!

Nov 13th NVC say they received our file.

Nov 15th NVC say they sent it to London. Now the last leg waiting begins.

We filed and sent our I-129F on the 9th May whilst I was in the USA. Texas recieved it on the 16th, cashe the check and then sent it to CSC (the K1 / I-129F applications are all now handled by CSC and Vermont). We registered in the USCIS website to track our progress and it says they got our I-129F on 21 May but we didn't recieve the NOA1 until 30th July! Patsy had called USCIS a few times and only got one helpful contact who said we were on track to get approved within 3 months of applying. (Aug 21st) According to the USCIS we've been TOUCHED once, on the 12th July and nothing since.

We're wondering when our "start date" is? Is it May 21st (When they say they recieved our 129F) or the 30th July (when we got the NOA1)? We found it encouraging that VisaJourney added an estimated approval date to our timeline details, based on all the members' info on here. They gave us the 18th Sept, then it was changed to 26th Sept. So the average time from receipt of 129F and approval seems to be 4 months.

London US Consulate say interviews are appointed within 75 days of them recieving the NOA2. So we're just hoping that I will get my visa in early December and be there for Christmas. It's sad that, with all the technology and info seemingly available, that all we seem to have is hope based on guesstimates..... And furthermore, if we didn't have VisaJourney we'd have to rely on the USCIS who don't seem to have one ounce of empathy or sympathy with genuine relationships.

I wanted to say all this in the hope it will help someone reading about our situation and to pin-point the grey areas of doubt.

* Your start date, should be the date written on your NOA1 or the date that appears on the USCIS website as the date the NOA1 was issued. This is when your process 'officially' started.

*Touches are not a MUST, we didn't have any touches after our NOA1 was issued and sent, and then we just got our approval, so there isn't a certain number of touches before the approval. In some cases there are touches and in some others there aren't any.

* Touches mean someone worked or looked at your file. Sometimes when people call to the USCIS a touch appears soon after because someone there went and looke on the file.

* The USCIS process timelines show the last cases they're working on. There are april and may filers that have been already approved.

Don't worry about receiving your NOA1 late, we got ours after 34 days since we filed! I was freaking out as many other couples got theirs in 10 days! At the end it doesn't really matter, we got our approval a lot sooner than other filers who their NOA1 faster than we did.

I suggest you look at the timelines here in VJ, it will giv you a better idea of who might be next on getting approved.

I will try to answer some of your questions/doubts.

ie *Start date (NOA1?)

I had the same confusion myself when I started this process but thru my research and readings here on VJ, I am fairly certain that USCIS seems to process applications in the order of their RECEIPT DATE thats printed in your NOA1. Again, I have read, thats how its suppose to work. Now, as we all know USCIS, its not always first come first serve but you can relate your case in regards with the receipt date in your NOA1. The notice date in your NOA1 is when your notice was generated. Someone please chime in if I my understanding is incorrect.

*How many touches are we supposed to look for? What is the usual amount?

* What do the touches signify?

Regarding touches, there doesn't seem to be any usual amount or number. Its totally haphazard but there are certain pattern. I have seen cases on VJ where an application wasn't even "touched" once but they still got their NOA2 and vice versa, meaning there have been so many instances where even after getting a touch or touches, it wasn't adjudicated. A touch means your case is getting updated(not to be confuse with being worked on, which may be the case btw). Update in this context could be that they are filing, shuffling your case between service centers.. or being worked on to get the final approval(NOA2). For me personally, I consider a "touch" as something is happening with my case but its fair to say that if you see a touch on your case after a long time(could be a few months) then its fair to assume that your case has been assigned, which may or may not end in the final NOA2.

In regards with USCIS processing dates, to keep long story short, DONT worry too much about them. Apparently, USCIS uses that date to "convey" to its customer that thats the furtherest(sp?) (as in past) date of application that they are processing but they could be and usually are working on cases that are filed much after that date. For ex., 13th Feb, in my opinion what that means is that they have approved all the cases that were filed on 13th Feb or before.
