Hi all, just learnt of i865 from this forum, my wife did not file it. I filed AR11 after we moved to the new house in June 2016. My wife who is the usc did not. Any advice on what we should do ? My i751 is pending and I am a may 2017 filer. 

 

This is a never ending psychological trauma for me. Appreciate your thoughts.

Paid an Avvo attorney for 15 mins and asked about it, she said just fill out I865 and send it to them. We have already filled out the form, I will send it out tomorrow as 2 day priority.

We just wish we had hired an attorney to do the whole greencard process, would have saved some stress.:(

It might have saved you stress to hire an attorney, but most immigration lawyers seem to make as many mistakes as we do! 

 

Lots of people have forgotten (or discovered late) about the I-865 - and generally speaking it isn't a problem at all - once you know about it, file it, and they seem to understand that you didn't know, and corrected your error as soon as you could.

 

In other news, try to relax about your I-751. They're running WAY behind and you'll probably be waiting quite a while longer. You may need to get a stamp in your passport if they don't approve you before your extension "expires" and renew your DL again for another year (or however long they give you the stamp for). It's all manageable, and shouldn't cause you any "psychological trauma." It's bureaucracy at its worst, that's all. Nothing more or less than that. Don't let them drive you crazy!

Thank you, I fully understand. I am OCD about these things, the type that counts steps and certain numbers, etc. So when I find out I missed something I go into a full panic, but that's me. My DL will expire around JUL 18 , I am hoping the I751 is approved by then. I appreciate your response and thank you.

My wife and I filled out an AR-11 when we moved to our new house back in 2016.  She is the permanent resident and I'm the USC.  Having just sent off our I-751 last month, now I'm like how did I not know about needing to update it for myself?  They sent out our I-797 last week to the correct address, albeit with her name on it.  So I suppose I have to fill out yet another form and send it in when we just sent our packet out a few weeks ago.  This is pretty irritating when you think you have all the paperwork done for awhile and you have to go at it again.

For others now and in the future who have this same question, I hope this helps. 

I spent $39 + $39 talking to the same attorney twice via Avvo who said to send the filled I865 and do not include cover letter.  The reasoning was the cover letter does not help, its late anyways, generally unless there is something sinister they will not come after you. Just know that you are doing the right thing by filing the I865, file it and move on.  This was the attorneys reasoning. 

 

I have my USC spouse filled the form and signed and I will send it out via USPS 2day priority tomorrow without a cover letter.
