a quick question: does everyone here also apply K3 at the same time?

Timeline

I am a new comer. My husband just submited I-130 this Monday. I just wonder does everyone here who apply for CR also apply K3 at the same time, and the only reason that go for CR is because I-130 approved before I-130?

I am asking this because I am thinking whether to take K3 or CR. I just started a new job here in Canada and it is better that I work over this year. Would CR be a better choice for me?

April 28 2007 sent I-130 to NVC

May 22 2007 application transfered to CSC

July 11 2007 received NOA1, decide to apply CR1 instead of K3

Aug 14 2007 touched (not sure if it is touched before Aug 14)

Aug 21 2007 NOA2 in snail mail :)

Aug 27 2007 NVC received our case, number is assigned.

Sep 11 2007 DS3032 and AOS bill generated and mailed out

Sep 12 2007 mailed out DS3032 from Canada and hubby mailed AOS bill in US. DS3032 will arrive NVC 3 days slower than AOS bill.

Sep 18 2007 Auto msg says NVC received DS3032, didn't mention AOS bill yet.

Sep 24 2007 IV fee bill generated

Oct 8 received IV fee bill. Still waiting for 864form

Oct 13 received 864form letter. It was issued on Sep 24 at NVC. Mailed out 864 on Oct 15

NVC agent said they don't receive IV fee bill nor 864. Send out IV fee bill again end of Oct.

Nov 8 IV fee bill entered to system

Nov 12 DS230 generated. But agent still said 864 is not received yet.

Nov 20 resend out 864 again(Hubby forgot to write case number on documents last time)

Nov 27 NVC Auto message said received 864, now waiting for 230

Nov 29 230 delivered. Will arrive at NVC next day.

Dec 3 NVC received 230 and put into its system

Dec 13 NVC operator told us the case is in administrative process.

Dec 14 Called operator again, and magically the case is completed!

It is possible that leaving the I-130 alone for a CR-1 visa might work for you. CR-1s are known to take longer than K-3s in most cases. I think the best thing is to check the timelines for both visas and your embassy to get an idea or how long each one might take.

05/03/07 - NOA2

05/10/07 - NVC receives petition, case # assigned

08/08/07 - Case Complete

09/27/07 - Interview, visa granted

10/02/07 - POE

11/16/07 - Received green card and Welcome to America letter in the mail

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

I can see from statistic at visajourney, the avg day btw NOA2 and interview day is 240, that is really a long time!

If I go for K3 and I still haven't finished my job by then, how long can I stay in Canada after got K3? Is there a time limit that you have to goto US within certain amount of days after K3?

You have 6 months to leave your country after you get your visa.

And after I enter US within 6 months, do I have to apply I-485, or I can just come to US and leave within 2 years? I mean is there a time contraint that when I shall apply I-485?

My only concern is that the time between NOA2 and interview is sooo long! Otherwise I will not hesitate to go for CR....

You can leave whenever you want.

There is no time requirement within which you must apply to adjust status. But if you do not apply, when your period of authorized stay is over you will begin accumulating overstay time until you do apply or leave the country.

You have 6 months to leave your country after you get your visa.

K3 visa holders have two years validity. 6 months is for K1. K3 is also multiple entry, so you could return to

Canada as often as you like. The advantage of CR1 for you would seem to be the ability to begin working in the US, as soon as you arrive here. With K3, you'll have downtime.

You must file the I-130 before you can file the I-129F. In most cases the I-129F is approved sooner and K3 visa issued in less time.

It's very unusual for I-130 to be approved prior to I-129f.

My sense is that in most cases people prefer a K3 visa because it still gets the foreign spouse into the USA more quickly than an immigrant visa, and speed seems to be most people's priority. If time to entry is not of the essence, and time to LPR status is the priority, then the immigrant visa may be preferable.

We did the I-130 for the CR1 only since my husband is finishing paramedic school and we didn't want to take any chances that the K3 would come in sooner than we were ready for. The CR1 was just a better option for us. Also, he wanted to be able to work immediately when he got here.

if you look at the link above, it gives you timeline of CR1/IR1 visas processed for Canada - I saw in one case petition filed in Sept. 06 and interview is scheduled for 22 May. Therefore, your CR visa may be done within 8 months which gives you plenty of time to get the visa, wrap up work and move to the States. You have 6 months since you receive your visa to activate it. And, by going CR1 route you can work immediately upon entry to the States (not the case with K3 unless you get EAD).

Best of luck on your journey whichever route you choose.

I am not in a hurry to work in US. I probably need a break then. :)

I just wish to get a US visa asap so that I can visit my husband and his family there. Maybe K3 is a better choice since there is no time contraint when I should adjust my status and I can come and leave US frequently within 2 years. I will warp up my work here end of next year the latest.

As a Canadian you should normally have little problem visiting, even frequently, no visa of any type required? Problems begin when visits are of such frequency and duration that one is arguably residing rather than visiting.

The immigrant visa will get you LPR status, which will allow you to leave and enter the USA frequently. In effect no different from the K3 visa in that regard.
