I wish you were right, but INA 319(a) says 400 applicant will lose his or her eligibility if the American citizen spouse dies before or after filing of 400, my husband passed three days after the interview, so if they go by law, I should be found ineligible. I will try to see USCIS and ask them what is going on. My lawyer told me if they approved me and were aware the passing of my husband, then I need to get that in writing to protect myself so I won't be responsible if they decide to densturalize me. I am still waiting for the oath letter. I will find out what is going on, but I expect to lose my eligibility though. Thanks for your wish and encouragement.

Guys, I don't remember if I have mentioned this. My 751 was actually approved on my late husband's birthday last week as I wished according to the approval notice. Last Thursday was his 90th birthday, the first birthday a month after he passed, we still celebrated his birthday in spirit. It was my biggest birthday gift from him in heaven and I know he is watching over me. It would have been too much of an coincidence. I still got an oath ceremony mailed notice through text and email  but I think it is an error, I will have to go to USCIS because due to the passing of my spouse, I should have lost my eligibility, I confirmed it with my lawyer and I will find that out by going to USCIS soon, if they decided to override the law and make me eligible for citisenship, I need to have that in writing for self protection of being de naturalized. Good luck to you all.

First of all,  I am so sorry for you loss. I am happy you got your 751 approved finally.

I already did my citizenship interview last April 30th and I passed it, but they have not made a recommendation for the oath ceremony yet because my I-751 case is still pending.  My N-400 case jumped over 751 one. I was told a supervisor would revise it and I would get a soon response. The immigration officer said that I was 95% approved, and I would not get any issues at all. 

In the meantime my I-751 online status is going crazy with weird messages, see below

Does anybody know what could be happening?

Thank you for your condolences, I think at this point all you have to do is wait. I would not look too deep into the 751 status. You will probably get in line for the oath ceremony update, they may skip your 751. Just have to wait and see.

The USCIS manual unfortunately says pretty clearly I will be rejected, it says the American citizen spouse dies anytime before the oath ceremony, the applicant who applied for 400 based on 3 year rule will lose his or her eligibility. I expect to, anything other than that will be a miracle. I just want this to be over, get my 751 approved green card and use it to re apply next August.

My 751 was approved on the 26th last month, and I got the approval notice in the mail to, but this morning I got an update saying my case has been transferred to another office? Still waiting for my green card. Has anyone who got your green card thought 751 got this update after the approval before? Got me worried a bit. Please share, thanks. From approval back to initial review??

Do they mention anything about making an exception under humanitarian compassionate grounds?  :no:

Just called USCIS, the officer told me I have already been approved and there's nothing to worry about, I am getting this message because all 751 cases in my city are all getting the same update being transferred to another office, she told me if i don't get my card in 30 days, please call them. 

About the 400, i also talked to the officer, they would not have scheduled my oath if they didn't approve me, so that is weird,,,oh god, i wish this were over already. I know I am fine, but all this system glitches are driving me crazy.

Oh, that explains it, i guess all the 751 cases pending and approved or not are getting the same message. What a relief for me, whew. I got panicky. Whew. About the 400, the representative on the phone told me the officer would not have scheduled my oath if they didn't approve my 400, so I have been approved, but no, no mentioning of humanitarian ground at all, I guess I will find out on the 23rd, I expect to lose my eligibility like I have been saying. I just hope I get my green card soon. Good luck to you too, this whole thing has been a nightmare for many of us.

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
