The refusal was because I failed to disclose information on the petition.  It was an expunged arrest from 1990 that I forgot about.  It is my fault.  I didn't read that expunged arrests mattered when I filed.  I was not convicted.  It was for battery.

Now we need to see if another K-1 or CR-1 is the better route.  I feel like an a$$....

I totally dont understand how they let you attend an interview knowing they would deny you regardless... why the hell did they approve your application, any thoughts? cruel pricks : /

I agree. They knew it was denied before the interview and before they kept all the passports. Oh well. We have to move forward, a little smarter and a bit more experienced.

Did they ask about your criminal record during the interview? maybe it was a setup for a getting you to falsify statements. you will notice when we applied a year ago the application didnt ask about even arrests for which there was no conviction, you probably filled it out correctly and they needed you to "lie" in the interview. now the updated application does ask about arrests even not leading to conviction.

look at your original I129f  It only asks about convictions not arrests. its changed now but you didnt sign an application that had any false info then. you might actually be able to fight this. they are confused thinking you applied under the current I129f application.

We are at a loss too. We will get through this. I will fly there to get married and we will file a CR-1 if we have to. Now we will just wait on the email.

My heart goes out to you and Rose. You will be in our prayers. It's just a test and that will not be reason to give up rather will give you more courage to be strong and even more faithful.

There will always be sunshine after the rain. God bless you!

No. It never came up. I wish they sent an RFE from USCIS instead of letting get that far. Either way, it is my fault for not really reading all the questions. I had nothing to hide. It was 28 years ago and the arrest was expunged. I take full responsibility and will do what I have to do to finally have Rose and the kids in my arms.

I agree, seems like they should’ve sent the RFE for that...I’m really sorry!! Hearing this makes me worrief about my own case being denied...but we are too far into this process to quit. Guess we’ll have to see how it plays out and if denied will have to consider spousal visa as an option

This is so CRUEL. I can't even...! RFE would have been so amazing compared to what you guys have been through. You are so brave and patient and it shows how great husband you'll be to Rose. And the wait will be so worth it one day!  We all root for you!

@John & Rose your not addressing what I said. Its freaking me out a little because I have an arrest. The charges were dismissed and I never had to go to court, I didn't disclose that arrest. Below you will see my form as it was 1 year ago. Clearly asking only about convictions. You cant appeal a CO decision but you absolutely can appeal based on a mistake in reason for denial based on technical rule mistake. If you filled out the same form as me I don't understand why your rolling over... Did you actually technically have a conviction that was expunged? Otherwise just an arrest they absolutely didn't ask about back then as the I129f form interestingly does now.

It is my fault.  An RFE would have been nice and I understand the concern on USCIS's part.  I am filing a new K-1 as soon as I get the missing paperwork.  I know the next interview will be tough on Rose as she will have the refusal in her head.  They were perfect and did nothing wrong.  I will be there with them again.  I still feel bad that my ignorance is impacting their lives but I will make it up to them.
