I-130 March 2018 filers [merged threads]

I-130 sent 3/21/18 for spouse abroad (US citizen)

Receved 3/23/18

Cheque cashed and received text message email on 3/29/18.

Receipt Notice I-797C received 4/2/18, and it said The I-130, Petion for alien relative has been received  by our office for the following beneficiaires and is in process.

I am forwarded to Nebraska service center.

So what is the next step ?

We have a cruise coming up so I’ll be flying to US. I wanted a copy of the NOA to keep along with other evidence. 

 

Now I was thinking - we did the i130 with my current passport in my maiden name. 

 

I wanted to get a new passport in my married name.  

If I do get a new passport - Do I need to tell USCIS that I have a new passport ? 

 

Does it matter ?

Or is it just making it complicated?

 

Should I get the new passport after everything is approved ?

I am not sure about USCIS  but I know that our visa and green card will be issued in whatever name our passport is. Hence, I’m currently in The process of legally changing my name here in my country to be able to get a new passport in my married name. (The application for name change here can take up to a few months). (If it goes according to plan, i’ll Have my new passsport in my married name before I start nvc phase) 

if your visa/ green card is in your maiden name, you’ll have to pay money & apply for it to be changed next time if you want to use your married name. (Which I feel will be a pain to deal with... so I’d rather get it all settled now) 

however, as that was my plan from the beginning, we filed the I-130 with my married name. I’ve read cases where some in this forum had updated their name with USCIS. So I think it won’t be an issue.

Next step will be to wait for them to process the petition till they send you the NOA-2 or any rfe.(usually 7-10mths). While waiting you can check out the NVC process and start looking at the proof/ documentation needed for nvc stage.

You can apply, however, it’s hard to get an approval, and even if you managed to get approved, 

you will need to be prepared that you can be denied entry upon arrival unless you have sufficient proof that you will be going back after the visit- what you deem sufficient might not be sufficient for the custom/immigration officer.

If you have proof of very strong ties back home, and it’s just a short visit/ less than a month, and have the extra cash to pay for it then you are welcomed to try. 

 

For me, I do have a valid multiple entry 10yr B2 visa as I usually visit every year in Dec-Jan since 2014, but I’m probably not going to try my luck this year because I don’t think it’s worth the cost involved to have a risk of being turned away and wasting my flight ticket there. But also I’ve been doing LDR since 2013 so I look at it as just another slightly longer time apart that comes with better returns- missing Christmas this year in exchange for future Christmas-es together. ;)

Thank you. That makes sense. 

We applied for i130 in my married name. 

However the passport number is the one in my Maiden name as that was all I had. 

 

I will I’ll change it as soon as the petition is sent to UK so I get my visa in my married name.

We received our NOA1 in the mail yesterday, priority date is 12 March. What exactly does the priority date mean? And where can I find the information for the NVC documents needed? Might as well start getting it all together!

Is your husband staying in your county with you and so you applied DCF / direct consular processing instead? That would explain the short approval. However, the rest of us will have to wait the 7-10mths. Maybe 6 if we are lucky.

I believe so, and yes the online forms DS260/DS261/ paid the fees and submitted the IV package via mail,  & for the i130 to be approve?

Well, the expedited processing in your case is due to the fact that your usc spouse isn’t residing in us at the time of petition and so can apply for direct consular processing. Lucky. But in that case your timeline Is not one that the rest of us can use as a guide because it’s a totally different situation than ours. In fact there is a separate sub forum for DCF filers.
