I got an email today from the NVC about mt husbands birth certificate that we reuploaded that was 2 years old. They came back today as invalid doc again stating the cant see all aide of it but you can CLEARLY see that is not true! The document was literally scanned in its entirety. What should I do guys? Uggh this is so frustrating 😣

I kind of get over looked it this group for some reason 🤔 But ill give an update anyway.. i talked to rep at NVC who said it was missing a stamp which wasn't true. I talked to supervisor who told me ro submit it zoomed out on a background which sounds ridiculous but no sense in arguing with them. I will resubmit tonight 😒 and the waiting still continues...

Oh m'en. These people are messing with your mind. You could have been CC and waiting for interview by won. Hope this time they accept it and give you your piece of mind.

Update on our case - we submitted our documents only for them to come back and request proof of domicile and that we need a Co-Sponsor. They said my husband didn't earn enough, even though according to their guidelines, he does. So just waiting for his Dad to send through his form and documents so we can upload them.

Then had to try and organize something to prove domicile as my husband is here in Australia with me, so it is difficult for us to prove it without him physically being in the USA. Managed to find a bank that allows you to open an account online, so we have done that and are including quotes for shipping containers and pet transport (we are taking our dog with us). Here's hoping thats enough!

My sister in law and father in law are also doing the same visa application too. SIL didn't get any queries and got straight through to Case Complete and has just received her interview date at the Sydney Consulate for 7 May (took about 2 and a half weeks from CC to Interview date). FIL got asked for more proof of domicile so he has just re-submitted everything too.

So we are on track but its been more than a year and counting!! I am so ready to move!

We had the same issue with proof of domicile. As I currently live with my husband in Brazil I don’t yet have a US address. Our US lawyers told us not to worry about it and they completed an affidavit for me to sign explaining the situation, that we will secure a US address as soon as my husband immigrant visa is approved, etc (kinda hard to secure an apt lease not knowing when the immigrant visa is approve).

The lawyers also attached the immigration law that explains that if the intending immigrant is arriving together and entering the US at the same time with the  petitioner then a proof of domicile is not needed. Our lawyers said that they have used this before with other clients and got approval.

We resubmitted the “proof of domicile” affidavit with the immigration law stated above on April 8th and now waiting for them to review and hope we get CC (they already accepted all the other documents). 🙏🏽🤞🏽

Hello Everyone,
First i would like to thank  you all from this Forum. We started this journey with some of you back in March 2018. Many of you have helped me with questions and I'd like to think i helped some as well :)

My wife had her Consular Interview today in POS Trinidad and was approved. She said the interview  lasted 5 mins (at most). Thank God this journey is about to be over.

For those of you still in the wait- keep faith, follow the process and it will happen. Take your time when submitting documents. You may read some of my past posts on mistakes i made in the NVC phase. ( i literally submitted a document rotated 90 degrees incorrectly smh) Non the less- all learning experiences. I am no Immigration lawyer but thank God was able to go through this entire process without having to hire one. This happened with the help from this Forum and God's Grace.

Take Care, God Bless and wishing everyone a speedy process!

For reference:

  • RFE from NVC on Feb 13 2019
  • Documentarily Qualified on Feb 27 2019
  • Got Interview Notice from NVC : March 13 2019
  • Interview on April 17- Approved.

Indeed you have! Good luck to you and Youre wife 🙏🏾🧡 That is AMAZING

Good looking. Congrats to both of you. Tell your wife to wave a big bye bye to the USEM for all of us. 😀

Ah its tricky isn't it! When we first submitted our documents, we submitted a statement that followed what it says in the Instructions for filling out the AOS form, basically that in good faith we intend to re-establish domicile when the visa gets approved, but they didn't accept that.

What is the law exactly if you don't mind me asking? I might try to attach that also and see if they accept it! Thanks so much for your help!

Here is the USCIS  law under "Use of Affidavit of Support", "Determination of Domicile"  paragraph "B":

"In the case of a sponsor who comes to the United States intending to establish his or her principal residence in the United States at the same time

as the principal intending immigrant's arrival and application for admission at a port-of-entry, the sponsor shall be deemed

to have established a domicile in the United States for purposes of this paragraph, unless the sponsor is also a permanent

resident alien and the sponsor's own application for admission is denied and the sponsor leaves the United States under a

removal order or as a result of the sponsor's withdrawal of the application for admission."

As mentioned, our lawyers had me sing an affidavit explaining why we don't have a US address and then she loaded the entire USCIS law about "Use of Affidavit of Support" which included the paragraph above.

Keeping our fingers crossed that they will finally approve this last document! Good luck to you too!

Okay another question - asking on behalf of my Sister in Law.

Shes got her interview scheduled with the Sydney consulate and its in 2 and a half weeks. She has just gotten an email from the consulate that says that they no longer accept a 1040 with the application. It says that they are required to submit a tax transcript.

Do we need to get the transcript for the interview? We've already submitted the 1040s and they've been accepted by NVC so would we need to get the transcripts as well?

Yes, she will need to submit the actual transcripts. I was told by an NVC rep that the consulates no longer accept 1040s.

She can get the transcripts via fax by the IRS. She just needs to call them and they will fax it to her anywhere. They fax my 2017 transcripts to me here in Brazil (the trick is finding a fax machine lol). Or she can get them online. I was not able to get it online as I kept getting an error. Here is the link:
