Filing form I864 with only 1 tax return

I don't meet the requirement for the financial minimum income for my wife therefore I will have my brother sponsor her and file form I864. He said he only has his most recent tax return from 2017 but has the figures for the last year. Is that fine? Can we just provide the 2017 tax return. Also should we provide just the tax return. What else is required? Thank you.

A copy of the most recent tax return is required, but you can provide the 2 years prior to that as well. The past 3 years must still have been filed (or provide a reason why you were not required to file).

 

It's simplest to to obtain the tax transcript form the IRS and send that (https://www.irs.gov/individuals/get-transcript). Assuming he is a wage earner, he should also provide pay stubs and a letter from the employer.

Note that the petitioner must also provide an I-864 even if they don't meet the requirements, and provide a copy of tax return/returns.

you should sent in the tax transcript. as  that is all that is needed. If you send in the return you must send  copies of any  documents  that was file with it such as w-2

also your brother will need to provide proof of current income.

current income and income on the tax return is not the same. I have seen people on here get RFE for putting what is on the tax return for current income question
