Hey guys,

Applied to have the condition removed on the December 5th, got Biometrics done and have received a letter stating that it's been extended for a year as they go through my case.. Is that normal? My PR card expires on March 5th. So I need to book an appointment at the Field Office to get I-551 Stamp? Is it normal that it's taking so long? I'm supposed to go to Scotland in September and now I'm worrier that I won't hear back from them before that. Can you guys tell me what is the purpose of the I-551 Stamp? Is that a must? Am I in trouble that I already haven't got it done and my card expires on the 5th? Would getting this stamp allow me to reenter US when I return from Scotland?

Also I have looked into infopass appointment and they have no appointment available... What should I do? Can I just walk in to get it stamped on my passport? I'm in Houston. I'm kind of worried that it's taking so long.. Does it mean there is something wrong with my case?

It is completely normal.  The extension letter extends the GC expiration date for one year from the expiration date on the green card.  You do not need a stamp at this time.  Removal of Conditions is taking a year in some cases......

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes it is normal.

No, you don’t need a stamp. Your extension letter extends the validity of your expired 2yr card until March 5th 2019.  You can get a stamp around that time for a further extension.  

Given that ROC is taking on average 12-16 months, you won’t hear back from them (aside from for biometrics) before your planned travels, so your worry that it hasn’t been completed yet are completely unfounded.

 

If you need to travel between now and then, carry the expired card and the original (watermarked) extension letter, as either one is useless without the other.

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

As for the stamp, when your extension letter is about to expiry, best to start making an info pass appt (for some local offices that are busy best to check around midnight or first thing in the morning and refresh your screen often)  about 6 weeks out.  Get a feel for your local office status; some are super busy others aren't.  I was able to book immediately. Most book 2 weeks out hence start 6 weeks prior.  You'd want to secure that stamp a month out.  

 

On the other hand some local offices are giving them out months in advance but I think it really depends on the IO tending to you.  I was denied an early stamp while my friend at another local office wasn't.

Well it was indeed a normal jointly filed case...but then add a disturbed attention seeking ex-spouse who has a penchant for telling porkies, plus a divorce waiver, and I guess it became not so straightforward (see my timeline below if you are interested). Very much the exception rather than the norm.

But then again look at nightingalejules who is already at 50% of that time - also ridiculous for a normal straightforward case.

So if I travel to Canada (home) in July and then Scotland in September, am I good to reenter with the letter or should I get the stamp before leaving. My letter is supposedly valid till 2019.

 

My god how backed up are they! Thank you guys. I was starting to panic...

You should use your expired green card and the extension letter to reenter after your trip in September.  Chances are that no office would stamp your passport 6 months out from the exp of the letter anyway.....dont worry. Enjoy your trip in Sept with knowledge that your case is progressing as normally as can be expected .

Generally speaking it's taking between 12-18 months currently depending on service center.  You are fine to travel.  The letter with green card allows reentry until 1 year after the green card expired.

My spouse is from a 'Developing country'....and we have no problems with the letter and the Green Card together with his passport. However, we are due to travel in November this year abroad..so probably mid-July we have to schedule an Infopass appointment. I was told that NYC is so backed up, that CT or NJ might be better to get the stamp.

I was thinking about the hundreds if not thousands of people out there who have no access/time or knowledge or Visa Journey and waiting on their I-751. What are they doing I wonder??? This is a perfect example of Government Bureacracy
