The USCIS  adjudicator will not ignore disqualifying evidence.

I wouldn't say that isn't too much evidence, that is just poor choice. Maybe tragic choice.

Submitting more that what the I-129 instructions explicitly request can be good, or in the instance I mentioned, it could be bad.   It comes down to what others have said.  Quality of information should supercede quantity of information.    Choosing in favor of quantity could increase the likelihood that something can be misinterpreted and increase the amount of effort required by the adjudicator, also slowing down your approval.   This is believed to be one of the reasons some petitioners reach NOA2 more quickly than others.

 

I agree with the others that quality documentation that supports the candidacy of the petitioner and beneficiary for a K1 Visa and meet the requirements of the i-129f submission should not risk approval of the I-129F submission.

 

The petitioner I mentioned previously thought he was including evidence to support his petition and intention to get married to his beneficiary in the US.  He did not anticipate that the USCIS would consider a foreign traditional wedding as a real marriage under US law.  Now he finds himself in a situation where he has submitted too much information to qualify for a K1 visa, but does not have enough documentation for a CR1.   Basically, under US law, he is married and has told the USCIS that, but he does not have documentation to prove it, thus he is in a hole.   It appears that he will need to get a certificate documenting his marriage and reapply for a CR1.

I agree quality over quantity  is better that why frontloading can be good

I still do not believe that a person at the USCIS is actually going to read everything unless it is necessary

or maybe that is the new guy training

trainer to new guy here is your case  it is only  3000 pages

of course that could explain why the USCIS is so slow if that is the case please I ask do not send any more evident that is needed till my wife roc is approve

I will try not to be. Good luck on your application  I wish I could say it gets better but it don't there is still long  wait  for other process, but is it  worth it yes

So they're going to have to go through stuff more carefully possibly. To see what you have and what you don't have that they really wanted. :D Thanks...  and really, the extra stuff I sent is paper-clipped together at the end of my packet. If they don't want to look at it, really they don't have to, lol

Let's get to the heart of the matter:

1.  It's the USCIS adjudicator's job to deal with whatever you send with the petition.

2.  It's the CO's job to decide whether or not to grant a visa, on the basis of what you've sent with the petition and on how you handle the interview.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Approved!! 👏🏽👏🏽 Here’s a quick run down from my fiancée:

1: tell me about your finace.
2: how did u too meet and when. 
3: have u met ur fiance in person if yes when? 
4: show me the pictures of you together.
5: why did u decide to get married in america and not nigeria. 
6: how come u and your fiance met and decided to get married when he has no background or relatives in Nigeria.

 

Well that was it and then he said congratulations ur visa is approved pls pick up ur packet and passport in 7 working days. 

 

Only took my letter from my employer about pay and position and the I-134, nothing else other than looking at the pics as stated above. So happy!
