Hello vj member,i don’t know if i’m in the right forum..please help me to have some insight regarding my step daughter’s situation,her husband will file ROC next month..but she found out that he is cheating and just fooling her for  past 2 years..he just used her to get green card and now god is good before the ROC she found out everything..is there any way we can do or she can do so that guy will not gonna succeed getting his 10 year GC?thank you for all the info..

If there is documented evidence that he only married for a green card, then report it to USCIS. You can make an Infopass appointment to do so. But note that it needs to be documented evidence...hearsay won't cut it. Beyond that, divorce and move on...he can complete ROC by himself if he can show that he entered the marriage in good faith (cheating alone isn't an issue for ROC...failed marriages and infidelity happen). Beyond that, there's nothing to do with immigration...it's his LPR status and he needs to remove conditions.

I read such case before - cheating in marriage is not considered as ground for LPR dismissal. Unless you can provide strong evidence proving individual entered into marriage ONLY for immigration purpose and it is not very easy to prove it. 

 

All your step-daughter can do is not file joint ROC and initiate divorce process. Let him file for ROC on his own and go through process whatever it is.

N-400 Application Timeline :

HardRock, tell her not to file with him and tell her not to give him any evidences or her personal info he could use at his advantage.  Don’t give him anything. Let him file alone ! The looser

That’s what i told her..i told her also to join here..so she can ask advice and information that she needed..thank you

She needs to keep aware, however, that divorce does not revoke his GC, he simply removes conditions on his own with a waiver which is generally successful. It also does not remove her obligation of the I-864. She is responsible for him if he becomes a public charge before the conditions are met.  

 

It is unfortunate she didn't discover the infidelity sooner.  But I hope she seeks some therapy for herself, and can move forward in her life.  Best of luck to her.
