Affidavit of consent

Hello all,

 

I would like to know if there is an actual template of a letter of consent.

 

I am petitioning my step daughters from mexico. I will file for an i130. When do we give the letter of consent, in the interview or when we file the i130?

 

Since I'm the step mom, we need consent from bio mom which is really tricky since ahe can be a pain. 

 

Can it be like, 

 

I, bio mom, give permission to bio dad/my hubby, to take bio kid to us to live and go to school. I do not have any objections. 

 

Or does it have to have my name,

 

I, bio mom, give permission to step mom and bio dad, to take bio kids to US

first of all you need proof that the person doing the affadvit really is the mother

so, be ready to provide this proof like her birth certificate with mother's name and the mother's offical ID

then prepare the affidavit / a lawyer would be a good way to go for all this

but there are samples of affadivats online '/should be in their native language with an English translation

Yes. We will have it notarized there. 

 

Does it need to be present when we file the i130 or it can be brought in the interview? 

 

I did my google research and i can't find anything about immigrating wiyh the bio dad. Its all jist travelling solo or vacation without the parents.  Nothing about permanently living.

You will need it for the interview. But if she doesn't consent, the children can't come, simple as that. 

 

I hope you don't refer to her as a "pain" in front of the children. She's still their mother.

And as for being a pain. She is, and her kids know that. I can't believe a mom will go home drunk at 2am on a school night with her FWB and make so much noise to wake up the kids. 

 

I mean, i won't try to replace their mom but I don't think she'll win mom of the year either.

I would suggest talking to a family/immigration lawyer since it's not just an immigration issue but also a custody one---he/she would be the best source of information on how the letter should read and what it should include.

 

If the biological mother is being a "pain", you may have to come up with an alternate plan if she refuses to give consent.

Some unsolicited advice: Maybe you should also look into some counseling for the kids. Even if it’s the best thing for them, I’m sure they still love their mother and taking them away from her is still going to be painful. And no matter what you think they “know”, badmouthing her in front of them is only going to make them resent you, now or later or both, especially when (as they almost certainly will) they hit road bumps in their adjustment to their new life.

This!!!! And I speak from personal experience. My parents had a very acrimonious divorce and my mother didn't hold back in letting us know exactly what she thought of our father. Result - I started to resent my mother and also struggled with my own self-esteem as I started to feel I must be a bad person if I'm the child of such a despicable and horrible person.

My dad remarried after my parents divorced.  My "step-mother" cannot stand my biological mother (for no other reason other than she doesn't want to acknowledge my father had a life before her, and jealousy) and constantly criticized her to me in every way possible....which in turn constantly made me feel as though she were bashing ME through her insults. 

 

Children agree/remain silent because if they don't, they fear it can affect the relationship with the other biological parent (the father) if they are seen as disrespectful for talking back or defending the biological mother.  Most of the time, the child is just left confused and bitter towards the stepmother later on as they grow older.

 

The woman my father married stated several times that growing up I showed her no respect....which makes me laugh....because how can I respect someone who doesn't respect my mother?

I just can't believe a mom could be like that.. sorry about your experience.
