* My half older brother and I have the same father.

* My father and his mother were never married. He was born out of wedlock (iligitimate).

* My father and my mother were married.

* Our father died months before I was born and my half brother was 5. 

* We are now both in our 30's.

 

Based on the guides,

 

qr_down.gif If you are a U.S. citizen seeking permanent resident status for your brother or sister, and you were and/or your brother or sister was born out of wedlock and not legitimated, and you are related through your father, you must file the following with the U.S. Citizenship and Immigration Services:


     ball.gif Form I-130, Petition for Alien Relative 
     ball.gif A copy of your birth certificate showing your name 
     ball.gif If you were not born in the United States, a copy of 
          ball.gif your Certificate of Naturalization or Citizenship or 
          ball.gif your U.S. passport 
     ball.gif A copy of your brother's or sister's birth certificate showing his or her name 
     ball.gif If anyone's name has been legally changed (if it differs from the name on his or her birth certificate), evidence of the name change must be submitted 
     ball.gif Evidence that an emotional or financial bond existed between your father and the child who was born out of wedlock (either you or your brother or sister or both of you) before that child was married or reached the age of 21 

 

***Does this mean I won't be able to petition for him?

You can more than likely bring him but the timeline is about almost 20 years right now for Filipinos.

Yeah lol. He can almost retire then. But what if he doesn't have the last evidence?

Something like a child support order whatever would do.

 

Being realistic assuming this option is still available he will be well past 70, is there much point?
