K1 visa applicant getting a SSN before marriage

Timeline

I'm currently filling out the form for my SSN as a K-1 visa holder who isn't yet married. For question 5 where the options are "legal alien allowed to work" and "legal alien not allowed to work" what did you go with? I am obviously not currently allowed to work as I don't have my EAD or greencard yet. However, it states that proof is required to obtain a SSN if you check "not allowed to work". How did you guys answer this questions/provide proof?

A K-1 visa holder is a legal alien allowed to work. They need an EAD to actually be authorized to work as well...so you can't actually work. But they are technically entitled to apply for an EAD.

Back when an EAD took ~30 days to receive, one could apply for an EAD before marriage/AOS and actually receive it (valid through the end of their 90 days).

 

This does not apply to any K-2 beneficiaries...they need an EAD or green card before an SSN since they are not authorized to work.

Timeline

I am of the understanding you need to wait 2 weeks until after you have arrived in the US before going to the social security office with your documents and I-94. How long is the I-94 valid for? Is it the 90 days? I am wanting to get it sooner rather than later but am trying to understand how quickly I have to get to the office.

The 2 week wait is pretty much obsolete now. Most people appear in the SAVE database within hours of entry anymore, so a day or 2 after entry is fine.

The I-94 for a K-1 visa holder is is valid for 90 days. To get an SSN, you must have at least 14 days of legal status remaining, so that means you have to apply within the first 76 days.  Otherwise you need to wait until you have an EAD or green card.

I went with my gf to the SSN office here in the US today. My filipina finacee was admitted to US last month (August 15) on a K-1 visa.  We brought a print of the I-94 and the application for the Social Security Number, checking the 'legal alien allowed to work' checkbox.  We are not looking for and did not apply for the EAD.  When submitting the forms plus showing her passport and K-I visa, the SSN rep went to look up the alien registration number, which is written on the passport page next to the K-1 visa.

 

Rather than saying everything was good, she told us she was unable to locate the alien registration number online to verify her entry status.  Huhhh?? She could easily look up everything online.  Anyway, she said she needs to have her status verified by federal, state, local agencies in the US who issued our documents.  According to the form letter she gave us, this will take up to 4 weeks and if approved. another 2 weeks to receive her card.

 

Has anyone experienced this?  Our whole visa application experience was quite easy as everything from the beginning approved on first attempts.

Its called the save system and verification is normal

Manual verification....usually due to some sort of mismatch on the name or DOB (especially with special characters and/or length limits with the SSA). It happens sometimes.

They were unable to look up her current record in SAVE. This is a different system than the I-94 system.
