No I meant the trend in the past few weeks for getting an rfe for a divorce certificate they didn’t have as it turned out they were still married to the first spouse or thought that it wasn’t areal wedding the first time.

Still not necessarily bad news...getting an RFE on the I-129F from USCIS is better than getting refused at the interview for this reason. If one were continue to the K-1 interview while married, they could be hit with a material misrepresentation bar instead (and otherwise just be refused a few months later, and after paying the visa fees and medical exam fees).

I think I do recall that.  They didn't think any paperwork was filed so they thought the marriage didn't happen but then they realized that it was registered...Sometimes you have to wonder if the beneficiary was being completely honest with the petitioner.  It seems like they were just going to get away with fraud because they failed to put information in the petition.

If you sent a full complete package you are OK.  RFEs can be asking for more proof of relationship or an explanation of something you answered.

An RFE for the I-129F will not request more evidence of a relationship as that is not a requirement of the I-129F. They can request more evidence of meeting within the past 2 years, though (or evidence of plans to marry within 90 days of entry).

Hi Everybody!
Well, sadly, RFE came through. August 21st filer. We are super bummed about it. Just looking for some insight, who else has received one? Does anyone know how long it extends the process by? My fiance and I have a ton of evidence of being together and of our relationship so I'm not sure what is needed. Will a letter come in the mail explaining what they're looking for?

Yeah sorry to hear  it always sad🙁  to receive an Ref but its gd to cause its always tells u what u forgot to send. I for one got Ref I was an August filer i flide my AOS August 2017 last year. We got an ref cause we didn't mail my husband most recent tax returns. So they told us on an ref that my husband did not pass poverty guidelines for Aos. So we submted what they wanted took us like two weeks to hear from them. So when ur ur ref comes in the mail they will tell you what they need in the letter. It keep  ur case pending it all depends on how quick u will respond to there mail that will help get ur case back on track.

That is correct. The RFE was for proof of meeting. I misspoke. The AOS is where relationship evidence is more critical.

WRONG ATTITUDE!!!!   RFEs are good.  It means your petition has been reviewed.  Generally it is about a week to approval after a satisfactory answer.  This is the next best thing to an approval.  Smile.  Generally the questions are an easy fix.  I just got an RFE earlier this week.  It was for additional court paperwork for my fiancée's annulment and proof that we met in the past two years.  Easy peasy.  Just wait for the letter and respond.  Many times it is a simple checkmark that was missed.  Congratulations.  This is actually good news.

Thanks so much! How long did it take to receive the letter? My RFE was mailed March 2nd and now it's March 7th and getting a little worried it got lost.

It took 5 days to get the letter from them but that was over a weekend.  They mailed it on Feb 21 and I got it Feb 26.  I sent it back overnight on the 27th and I got notified they received it on Feb 28.
