These are the reasons the Uscis will expedite a case, now i need to know... can someone give me some Good examples.

USCIS reviews all expedite requests on a case-by-case basis and requests are granted at the discretion of the office leadership. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met.

USCIS may expedite a petition or application if it meets one or more of the following criteria:

  • Severe financial loss to company or person;
  • Emergency situation;
  • Humanitarian reasons;
  • Nonprofit organization whose request is in furtherance of the cultural and social interests of the United States;
  • Department of Defense or national interest situation (These particular expedite requests must come from an official U.S. government entity and state that delay will be detrimental to the government.);
  • USCIS error; or
  • Compelling interest of USCIS.

It’s irrelevant how other people had expedited approved. Unless the exact same situation applies to you, it doesn’t help much.

Since you asked, I do personally know a family where the case was expedited. Reason was that the USC was in advanced stages of liver failure and expected to die. He was waiting for a transplant and actually had the transplant days after the immigrant arrived.

I mentioned on your other thread that you can request an expedite based on the fact that the I-130 for the children’s father has already been approved but other than that bad advice from your lawyer or your failed attempt to get a K-3 are not usually reasons for an expedite.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

I did see your response and I thank you so so much for your advice!

So my other reason for us expediting the I130 beside having the I130 for my husband already approved,  is that my husband is the only person taking care of the children in Uganda , he and I have fully supported the children... school fees and given them a stable life.  the mother left them to my husband years ago and isn’t involved and doesn’t support them in any way.... my husbands income and mine together have helped  the children live a stable life but  my husband  was just laid off and has not been able to easily find another job since there is a shortage of jobs and so my husband not being able to accept the job he has lined up for him the us is a Financial  loss for us and be kids. if he doesn’t migrate with the kids now They will be struggling in Uganda and i will be struggling here too and we don’t want to leave the kids alone in Uganda either and allow him to come because there’s no one to care for them and he won’t abandon them .the situation in Uganda is hard. There is a lack of jobs and a refugee crisis and Uganda is at a brink of starvation’s fue to famine and drought. I saw that was a reasons for expedite. We can prove all of this. Do you think these reasons could be enough

I don’t see any approved expedites from members here whose spouses are in Uganda. And there are many countries that are in emergency situations. But it costs nothing to request an expedite so it’s always worth a try.

Have you sent the I-130s for the children yet? You can’t reqyest an expedite until after the I-130 has been received.
