You need to exceed the poverty level for your family size. This year is what you'll use.

You should consider finding a sponsor to play it safe. 

If it's just he and his fiance he passes the test. No need for a sponsor.

Its not by state. Its a national measurement and a visa requirement. See my link above. Everyone is measured against. If you don't meet the poverty level you may try a sponsor. Keep in mind most Embassy's do not except a sponsor.

Thank you, well this year because i am in graduate school i was not able to make much but 20k. But between savings and a trust about 40.

Poverty level standards are applied to both 134 and 864. He stated he made 15k for 2016 and 2017 he made 20k. They will look at 2017 and apply against the pov. level req. For 2 its enough and he doesn't req. a sponsor. They don't average his income over any set years just use the last year.

however, there are plenty of cases that look at all returns brought to the interview. Even some folks have been approved without meeting the minimum. (Met the minimum on all years except current) Everyone's case is different :) this one just confused me but thanks for clarifying! 

If the employers letter state they will make more then last year then yes it gets approved. It's very unlikely that they will get approved If they don't meet the guidelines somehow. Everybody's case is the same when compared to the pov guidelines. Where the proof comes from is different for each because it can come from an employer letter or IRS transcript or a sponsor.

Timeline

After much brain draining research done last night, I found a link where Atti can register and pay for his visa in Hungary. I don’t quite remember how I got there but I think it was when I realized K1 was a non-immigrant visa that I was able to click on a link which allowed us to pay for “non immigrant” visa and schedule an appointment. Atti created an account this evening with his personal information and was asked to pay for visa and advised that only after making the payment he will receive a package (3) with further instructions.

If it wasn’t for all the search I did last night we would have still be here trying to figure when we will receive the so call packet 3 everyone talks about. Who knows how long we would have waited expecting to receive further instruction form embassy. I think there are a few people here waiting to hear from embassy/consulate after NVC, can’t help but wonder if it I s the same situation for them as it is for us in Hungary.

Actually you are right, I did put a Wac number there too. My mistake.

This the previous two years i was below, but this year i think i am okay. I was confused because i saw people collecting previous 3 years. Currently for this year i made the 20k and i can get a letter from my employer stating that for at least 2 more years i'll make that since it is based on a salary pay contract. would this work?

sadly - still no case number!

i called at 2am aka 8 pm their time, and still nada. at least i had daphne on the phone who i never

had on the phone before! lol it's just frustrating to see they got the case on 23rd, and i read that someone had the noa2 on 20th, nvc got it 30 and assigned same day. stuff like that is what makes me more frustrated.

i know they don't follow a strict structure on processing in order, but as a swiss and following strict guidelines and be fair and all that stuff,

this is hard to swallow... and i knoooow it can take up to 8 weeks and blablabla - and this is not to panic or have someone else feel it's wrong

to wait for weeks...

 

i have a good to do list for distraction so i keep doing all these million little things (not K1  related) that help get through the days now.

it's the circumstances that make everything hard. you (or your partner) as a swiss will understand, we have the 3 months notice periods in this country

for everything so we had to pick a date last year when to quit job/apartment and that's the hard part right now. knowing i moved out of my

home that used to be my comfy spot (end of jan) and i quit my job due to the location where my family stays (2 hour travel per way). so 

working 10-13 hours daily with all the responsibility and challenges, and now coming down from 100 to 0 is crazy.... for body and soul.

but we're almost there, that's why the to-do list i created will help to get through the next few weeks ;)

I am the American, my Swiss fiancé is here right now luckily, actually we are baking zopf right now :)

Hope since you wrote you have received your NVC case number (I'll run through the boards to see). I am going to call the NVC next week, it's actually nice to have a week off of looking at the site. My fiancé does freelance work so he has a flexible schedule, I can imagine the 3 months notice would be very hard in light of the crazy delays we've had to go through this year. He flies back on May 1 and we are hoping he will get his interview and medical done then and hopefully fly back right after. Hope this goes quickly for you and you're new comfy spot is right around the corner. Thank you for your feedback, I'll keep you posted on my end too if anything changes, that would be funny to have an embassy interview at the same time, but I'm hoping you have it way before us!
