It gets weirder.  The 2GO was setup for pickup at MOA.  The text Rose got said "US visa del today".  When I talked to the embassy they said that they have no record of 2GO yet and that if the passports were being returned it would say "US passport del today".

They have escalated this at the embassy since it should go to 2GO MOA and they say it will be delivered.  There is something weird happening.

The refusal was because I failed to disclose information on the petition.  It was an expunged arrest from 1990 that I forgot about.  It is my fault.  I didn't read that expunged arrests mattered when I filed.  I was not convicted.  It was for battery.

Now we need to see if another K-1 or CR-1 is the better route.  I feel like an a$$....

I thought they did all background check on US petitioner before they issue NOA2. If you have already been approved for NOA2, did medical and interviews, why would they go back AGAIN and deny you? I am totally lost.... I am so sorry to hear about this, John! But the way they do this to you is NOT right!!!

Yes, USCIS should have caught it and issued an RFE.  That doesn't matter now.  It is on me because i didn't completely read the application when I sent it.  This is my fault.  I did this to us so know I will fix it.

There is no way to know John, honestly! They scrutinize everything, every damn bit. I know that when we were doing the DS160 I must have beaten Atti hard and steady on how he needed to be conscise on the times, dates and explanations on the questions they asked pertaining to his visas to USA. Typical guy responses are, sorry for the generalization :( “yeah, I don’t think it’s necesasry or important”, “I forgot about it” we fought like cats and dogs about this and I was screaming on the top of my Lungs how important accuracy and transparency was for this, but he didn’t get it. I hope he gave me the absolute truth about this. Not that I believe it is his intention to omit, it’s just the nature of the beast. All we can do is learn from our mistakes and move forward. I will know soon enough when our interview comes May 9th. I’m in agony thinking we missed something too. I’m sorry for what you are going through... there is no real way to knowing what to expect especially when they have gone so far in the damn process. ☹️

would you consider moving to the philippines since you love it there so much and the process would be probably a million times easier and faster?

The problem is there is no work if you are over 35 there. Average wages are around $6.00 a day.

What do you mean a year?  I’ve hear a K-1 only takes 3 to 5 months!  (Remember, I’m a noob again!)

It's great that you can make light of this dark situation. Please always keep that positivity with you! I've been lurking for awhile and my heart sunk to my toe when I read that post. I can't believe that they would use something like that as a refusal either. I could have understood AP and requesting that you brought in things pertaining to the arrest but just not a refusal. I'm sorry that you and your family have to go through all of this and I hope that there will be something that turns all of this around because remember that everything happens for a reason. I'm sure something positive will come out of this for you.

What to do after NOA2:

Spoiler

After USCIS approves the petition, it is sent to the National Visa Center (NVC). The NVC will assign you a case number and send your petition to the U.S. Embassy or Consulate where your fiancé(e) lives.

The NVC will mail/email you a letter when it sends your fiancé(e) case to the U.S. Embassy or Consulate. Once you receive this letter, inform your fiancé(e) to take the below-listed actions to apply for a K-1 visa and prepare for the interview.
