 Is putting  my non-resident spouse on my LLC company a good idea for proof of bon fide marriage?

 

My Spouse is from the Philippines, i am from USA. we tried to open a bank account in the Philippines but no bank would let me do it because i did not live there. I think she cant get put on my bank account here in the USA from what i heard on the internet. I spoke to North Carolina Secretary of State today and they confirmed i can put her on my LLC as a member/owner. however im not to sure about what the IRS and USCIS are going to think about that. also im thinking if I do it she cannot work for the company nor earn an income because then it be like the company hired an illegal alien and i think thats against the law here. it would be kinda cool if it works because i could then show the we own the company and the company owns this bank account and it owns these bills etc. and thus we have joint accounts and bills together : )

Don't muddy the waters. There are plenty of other simple things you can include as evidence (not proof - that's impossible) of a bona fide marriage. Time spent together is the best evidence of all. Focus on that.

NOA1: February 8, 2016 Nebraska

Interview: December 6, 2016 London

The question is not one of whether the US Citizen thinks they are in a bona fide relationship.  It's about the foreigner.  Evidence you are providing financial assistance can actually work against you.  Focus on evidence of time spent together in person and examples of how and how frequently you communicate.

Facts are cheap...knowing how to use them is precious...

Agree to disagree. We provided financials tho meager, photos, wedding invitation, and NO other evidence of time together or communication.

That some get by with little or no evidence is not reason to advise others to try to do the same.  A US Citizen marrying in the Philippines is evidence of at least two weeks spent together in person.  (Unless the USC is also a Philippine Citizen)

Not advising anything of the kind. 4 of the 6 paragraphs adressing evidence: joint property,  joint lease agreements, joint financial accounts, and affidavits are all too often discounted from what I have seen on this site. IMHO 

Instructions say to send one or more....... providing clear and convincing evidence.  

The OP asking about joint llc (evidence) IMHO

Thank you! It never occurred to me to think of my passport. Actually, my husband's name is in my passport, on my Brazilian permanent visa stamp. He sponsored me for my Brazilian permanent visa, so I guess that will be strong evidence. Thank you again!
