Hi my bf is from Sonora Mexico and is currently visiting in California. He entered US with a tourist visa B1B2. His visa is good for 10 years. His permit will expire on July 2018. I am a US natural born citizen. We want to get married. Our question is does he have to leave the US and then should I file for the K1 fiancé visa or could I file for a K1 visa now that he's here in the US. Also  we want to get married here in the US now. Please help and let us know what the process is. We are hoping he doesn't have to exit the US and that we can do everything here.,

You can file for your K1 just fine, but he will have to go back to his country and wait for the K1 to be approved.

8/14/17 --- AOS sent I-485, I-765, I-131

8/16/17 --- AOS Packet received Chicago USCIS Day 0

8/21/17  --- Received email & text notification 

8/23/17  --- Received hard copy of NOA  

9/01/17  --- Biometrics letter notice for I-485 & I-765 & I-131  

9/11/17  --- Biometrics Appointment Done

10/17/17 - Case Is Ready To Be Scheduled For An Interview

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
12/06//2017 - Card Mailed (Priority Mail) to Me
12/07/2017 - Card Received 

1/19/18  --- Interview Date 2/21

2/21/18  ---  Approved on the Spot

  • 1 hour after the interview received uscis mobile app alert
  • Status changed from "Interview is scheduled" to "New Card Is Being Produced

2/26/18  --- Received hard copy of NOA for the Green Card

2/26/18  --- USCIS Mobile Status changed to "Card was mailed to me"

2/28/18 --- Permanent Resident/Green Card received :jest:

" Have you tried the search tool? K1 isnt an easy process and a LOT of reading is required to avoid problems (RFEs) etc, if you dont like reading, be prepared to spend WAY more time and couple more $$$ with an lawyer "

You can marry and he can adjust status without needing to return.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

If you get married, wait more than 90 days after his entry in the country. Even if your bf entered the country without the intention of getting married, USCIS can claim differently if the marriage happens in the first 90 days of his stay in the US.

 

I believe it wasn't planned, but is better to be sure and be eye to eye with the way USCIS see things.

AOS with pending I-130 (F2A):

March 2, 2018: AOS Package PD (I-485, EAD, AP)

March 14, 2018: NOA1  / E-Notification // Physical Mail: March 20, 2018

March 17, 2018: Biometric Appt Notice received //  Appointment: April 6th

March 29 RFIE // April 11 USCIS received RFIE response

May 10, 2018: I-130 Approved  :D *But case sent to NVC*

July 11: INFOPASS Appt + Sent Additional Documents

July 20: Case Ready for Interview (Finally!)

August 14: Card being produced //  August 22: Combo Card in hand
