Okay so this might be redundant or a dumb question to ask, but I'm going to ask anyway because I am a very anxious person. 

 

I have a few questions for everyone about this visa process. I will tell you guys a little about our situation first. 

 

I (Caitlynn) am the US citizen planning to marry my fiancé from Sweden (Johannes). I am 20 and he is 19, but we will have been together for two years soon (yay!) and would like to start the process as soon as he is finished with school (2019). We have met four times in two years: Him to the US (December 2016-January 2017/two weeks) Me to Sweden (February 2017-March 2017/ten days) and him to the US twice more (June 2017-August 2017/two months and December 2017-January 2018/two weeks). We have yet to start the process and I have read so much information my head spins, so I thought I would come here and ask directly. He will be moving here and we would be living here, in the United States.

 

I have found myself to be in quite a bit of credit card debt, due to moving out and not knowing how expensive it was going to be. It completely wiped out what little savings I had and added $8,000 worth of credit card debt to my name. Will that affect us and our likeliness to get approved once we start applying? Due to me having debt, I was looking into getting government assistance in certain areas. It might sound stupid, but would that affect us as well?

 

My other question is about mental health issues, are there any non-threatening mental illnesses that will get you denied? I'm talking about illnesses such as depression and anxiety. 

 

I had more questions but they are completely escaping my mind at this time. Thank you for your patience if these are common questions or dumb to ask.

Others might correct me but I believe that credit card debt is not taken into account with the financials, they look at income and if your income is insufficient they look at your assets.

 

As far as mental health, I'm pretty sure they only look at the mental health of the beneficiary (in your case Johannes), your health as the US citizen is not inspected.

Debt in itself won’t affect petitioning but do you have the money for the fees as there are no fee waivers for adjustment of status, there are more fees overall to get the green card for the fiancé visa than for the spousal visa route. Do you earn enough or do you have a co sponsor who earns enough to sponsor?

 

Mental health of whom, the petitioner or the beneficiary? If petitioner don’t care, if the beneficiary there are questions on the medical but if they can get a letter

from their doctor saying that they are not a danger to themselves or others then it should be ok.

We are putting back small amounts of money each month to be able to pay the fees. This will probably sound silly but my mother makes ~$70k a year and has agreed to cosponsor with me, due to my income most likely not being enough as I am an assistant to disabled individuals (and we don't make that much money).

 

It's his mental health, he has depression and other things (ADD, etc) due to having Asbergers (autism spectrum).

With a co sponsor for the I-134 (and joint sponsor for the I-864 later), you should be fine. Your credit card debt isn't an issue for the visa or AOS. Then again, if you did make enough on your own, you would be fine that was as well. See the income requirements here: https://www.uscis.gov/system/files_force/files/form/i-864p.pdf.

 

As for the medical side of things, he may need to provide evidence that he is not a threat to himself or others. They may request a psychological evaluation.

Thank you so much for the link with information! I did not have that information and it is extremely helpful.
