I wasn't sure which forum to post this on... So my husband and I got married in May, and we still haven't heard anything since we filed the I-130. I'm trying to do my taxes now, which are usually pretty simple, but idk what to do now that i'm married, but my husband isn't here in the US. Obviously he doesn't have a social, which is necessary for the filing, how are you all doing this? I am in the process of filing seperately on HR block but it is asking me why I dont have a social for him and I  just selected that he is not a US citizen, and now it is asking how he will be filing, which I have no answer for. I just want to do it the right way and make sure none of this will affect our case negatively.

Thanks

One option: You can file "married-Separately"....in the field for his SSN, write "NRA".  He is a non-resident alien.  The return can not be filed electronically.  It must be mailed......That's what I did for tax years 2015 and 2016.

Note:  You can not take a spouse exemption if he has neither a SSN nor Tax ID Number.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

As long as you are filing as 'Married Filing Separately' you should be okie. When he gets his green card, you can go back and amend to 'Married Filing Jointly' if you wish to claim higher deductions. Do take care that you don't file as 'Single'-- seen plenty of cases here where people are advised to do that by tax preparers...

It is my first time filing through mail. Do you remember how long did it take for you to get tax return? I know usually it takes a couple of weeks if filed online. I'm just wondering when will i be getting the return.

Thanks.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).
