Taxes not filled I-864 - Help please

Hello Everyone,

 

Thank you for reading this. I have 2 questions

 

1. I as Petitioner did not filed taxes in past 3 years because in 2015 I was student, In 2016 I worked for 3 months total income was less than IRS threshold to file taxes. In 2017 I was student again. My question is do I need to fill-out I-864 form and attach a letter explaining the reasons for not filing taxes or I do not need fill out form and just attach the explanation letter.

 

2. I have joint sponsor he recently filed taxes for 2017, do we need to wait to get it approved and then get tax return transcript form IRS to attach or we can use his filing documents i.e 1040 etc?

My husband is the same as you. He did not file taxes for the last 3 years when he filed my CR1 due to him being a student and not sufficient income.

 

Your petitioner needs to fill out I-864 along with a signed explanation.

 

Then, your joint sponsor will fill out another I-864 along with the tax documents. We did not submit tax transcript for my joint sponsor just the tax forms along with W-2 and other tax documents he used to file taxes on the recent 3 years, 5 recent pay stubs and a letter from my joint sponsor's company confirming that he is a current employee.

 

But as much as possible submit tax transcripts.

Sponsors are required to submit tax returns for 3 years but my sponsor become US Permanent resident in 2016 and he have tax return for 2 years only 2016 and 2017 but his annual income is more than poverty guideline. Is that acceptable?

Write a letter for 2015 explaining why no tax return. Just say he just started to be a PR in 2016. and have him sign it.

 

They will look at current income so if your joint sponsor is above poverty guideline then you should be fine. Just remember to include recent paystubs, job letter, evidence of him being a US resident which is the scanned copy of his green card along with his tax documents.
