I’m in California. Sent my paperwork to Chicago though. I believe the NOA1 is originated from Chicago though not my field service in CA.

So I am on H1B with an employment I-140 approved but dates are retrogressed and I have A#. I filed AOS + I-130 based on marriage to USC last week. I mentioned my A# on the forms. Does anyone know if how the existence of A# affects processing? Does it speed it up or slow it down or is it irrelevant?

 

My I-140 was approved in Jan 2018 so the background checks on that one are recent.

 

I would appreciate if anyone can shed some light on this.

I just received an RFE in the mail for my I-485 application. It states as follows:

• Submit all supporting tax documents (W-2s, 1099s, Form 2555, and all supporting tax schedules) submitted to the Internal Revenue Service for the most recent tax year. 

 

The petitioner/sponsor must submit all supporting tax documents for the most recent tax year.

 

• Based on the documents submitted with Form I-864, Affidavit of Support, for the petitioner/sponsor, the income did not meet 125% of the poverty guideline for the petitioner/sponsor's household size.

Submit evidence of assets that meet the standards listed below or obtain joint sponsor.

Assets must equal the stated difference between the petitioner/sponsor's household income and 125% of the poverty guideline.

• Assets must equal the difference for applicants filing as orphans. 

• Assets must equal three times the difference for a spouse or child of the United States citizen.

• Assets must equal five times the difference for all others.

 

Evidence of assets includes: 

• Bank statements covering the last 12 months (statements will be averaged over 12 month period) or a statement from an officer of the bank or other financial institution in which the sponsor has deposits, the account balance averaged over a 12 month period, and current balance; 

• Evidence of ownership and value of stock, bonds and certificates of deposit; 

• Evidence of ownership and value/equity of other personal property and dates acquired;

• Evidence of ownership, a recent licensed appraisal or county tax assessment, and any mortgage/lien or lien release of any real estate.

 

And then they include information for if I need to obtain a joint sponsor. 

 

I have 87 days to respond. 

 

The problem I have is, my spouse makes over the poverty guideline for a household of 2 (makes $37,000) but only started this job 6 months ago. We submitted his past W2s and tax transcripts for the last 2 years and his most recent W2s from 2017 (it was too early to request tax transcripts). We also submitted a letter from his employer. I'm wondering why we're getting a letter stating he's not making enough. 

 

Also, do we have to submit evidence of assets if he makes enough money?

If he has done his 2017 tax returns already, send in a signed copy of his tax forms that he mailed of to the IRS, along with a copy of the W2 on top. get a letter from his employer stating his job title and salary and when he started the job on company letter headed paper. Write a cover letter explaining everything too, and maybe consider sticking tabs/highlighting bits to show he meets the requirements.

 

No assets needed if he meets the threshold!

Yes. Send whatever tax forms were generated online for his records along with a copy of the W2 for the year.

Hi everyone,
I haven't joined a forum since I was in high school, probably! But since I've been finding myself scouring these pages in the last couple of weeks and I finally filed (!) I thought I would join and benefit from the hive mind

It's been a super long process for me - I've been in the US for almost five years now. My status is EB2, and the PERM process took two years to start and file (PD Aug 23, 2017). It was approved Jan 6, 2018. Lawyers received it end of Jan 2018, took six weeks to prepare all the documentation (they are so so slow), and then FINALLY we filed I-140, I-485, I-765 and I-131 on March 16, 2018.

It arrived March 19, 2018, and I got all the receipt notices by March 26, 2018. (Nebraska center)

The first magical thing in the whole process then happened: I'd filed the I-140 for premium processing, and it got approved one week later, on March 28, 2018. So I'm hoping it's a good omen for the rest of the process! Super anxious about the EAD/AP. I have an important trip late June, and I'm really hoping it takes 3 months to process, and not much longer. Awaiting biometrics now. Fingers crossed. I look forward to waiting this out with everyone.
