March 2018 AOS Filers [title edited]

Your congressman/senator should have a form on their website which allows you to 'request assistance with a federal agency'. You can also request an expedite over the phone with USCIS. You'll need evidence proving whatever you're alleging.

 

That said, I would not be worried if I were you. If you have a March priority date you should definitely have it by August - that would be maxing out the highest end of the NBC's current processing times. Not to discourage you, but you might have a hard time proving immediate 'financial hardship' in April when you still have a valid EAD for the next 3 months.

Yeah. You make a great point. Hopefully it doesn’t surpass July. I thought about renewing DACA, but even DACA is taking some time to renew as well. That’s money spent on something that I might not need.

It took nearly a month for USCIS to acknowledge the request, but only took about 11 days to approve once they did.

Did they email you notifying you of approval? We requested to expedite last week, received an email the next day to fax additional proof, then received an email this week stating they received our request and that it is currently under review and we will receive a decision or notice of further action shortly. Is this similar to your process? Just curious about what we should expect next.

Did our biometrics appointment today! Got a notification that they are sending a RFE, hope to be able to complete that as soon as it gets here to keep the progress going.

That's identical to my experience expediting through the phone. Faxed everything on the 6th of April. My Senator's office's expedite was started before that but USCIS didn't acknowledge it in the 'case history' until the 14th. I saw someone in the January filers also got theirs expedited about 16 days after faxing the evidence, so it looks like 10-20 days is the processing range.

 

I got an automatic email sent from the "new" DHS/USCIS site - the old USCIS.gov site didn't update for about 6 hours more. Now just waiting for it to switch to 'mailed'!

• Evidence of ownership and value of stock, bonds and certificates of deposit; 

• Evidence of ownership and value/equity of other personal property and dates acquired;

• Evidence of ownership, a recent licensed appraisal or county tax assessment, and any mortgage/lien or lien release of any real estate.

 

And then they include information for if I need to obtain a joint sponsor. 

 

I have 87 days to respond. 

 

The problem I have is, my spouse makes over the poverty guideline for a household of 2 (makes $37,000) but only started this job 6 months ago. We submitted his past W2s and tax transcripts for the last 2 years and his most recent W2s from 2017 (it was too early to request tax transcripts). We also submitted a letter from his employer. I'm wondering why we're getting a letter stating he's not making enough. 

 

Also, do we have to submit evidence of assets if he makes enough money?

Just received my RFIE and its the same reason as yours. I have only been at my job for 5 months and would easily make over the poverty level, just never showed on my tax transcripts and w2s. Going to send in additional pay stubs and bank statements to show. We already got a letter from my employer stating I would make enough, but obviously that was not good enough.

Any advice?

This is a tricky one as I submitted just about everything and still got an RFIE. I think what they're looking for is something solid from the IRS to prove that you make enough. I resubmitted everything including 2017 tax return for my husband and haven't heard anything since. I think your best case scenario if possible would be to get a sponsor since your documents can't prove that you make enough. 

If a sponsor isn't an option I can only advise that you include a detailed letter explaining why your documents can't show that you do make enough. Include in there your estimated annual salary and highlight that. Then include the page with the poverty guidelines for 2018 and highlight your household size. Highlight your current income in your job letter and include all paystubs from working at the new job. Highlight the payments and the job name on those also. Include bank statements with your payments highlighted for the past 5 months. I would even wait 'til the 6 month mark so you have more to give them. Be as thorough as possible. Good luck!

And to @APGG94

I'm a Feb filer and received the same thing. Same situation. It has been a month since I responded, and it seems good (I think). 

In our original submission, I included a letter explaining the lack of tax return. I also included husband's W2, 6 months pay stubs,  and employment letter stating that he makes $x amount and he is a full time employee. 

Received an RFIE on that one. What I did was get a joint sponsor instead of further proving that husband makes above 125%, because we don't have any more docs to send. So I got a joint sponsor with 3 years of tax retuns and W2.

Thank you! That is what I exactly did too. I only swapped Form i-864 because they came out with a new form in March which I didn't see. I am glad you also resent the same paperwork and that it got accepted. I am following your timeline. If I am lucky I will receive something in about 8 days. ^_^

Are you F2A? Probably not. :D
