Hello Everyone,

My husband is a permanent resident and has been here since Nov 2013. He is eligible for citizenship, we just haven't done it yet. We found out that his almost 18 year old British son would like to come live with us. Should he file now for the I130 or wait and become a citizen first? Obviously being a citizen would speed things up, but if he files the I130 and then becomes a citizen down the road a bit, will it be detrimental (cost more (other than the citizenship cost or cause more complications) or just helpful? We've been out of the immigration loop for a bit and with the new US administration I wasn't sure if things have changed in a crazy way.

Never received packet 3 although it was mailed to us on May 29th

07/17/2013-Sent off packet 3 after finally getting ALL our documents together

08/19/2013-Medical scheduled (there were earlier appointments but unfortunately, we couldn't get there for them due to hubby's work)

09/24/2013-Interview APPROVED

11/01/2013-POE BOSTON

01/13/2014-10 Year green card received

03/09/2019- Sent I-130 to Chicago lock box for step-son

03/20/2019- NOA 1

Hi!!!

 

Right now, a F2A visa is taking around 2 years from filing dates to Visa issuing. I would say filing I-130 and then applying for citizenship is the best way to go if you can afford to pay both fees, right now in Manchester, NH it is taking 5 months to process N-400, but by that time it is more than likely you would still be waiting for the I-130, as a US Citizen it would be processed faster, and you wouldn't have to wait for a Priority Date to be current. In the best case, it could save you even a year in the overall process. And time is kind of important here, because if he goes over 21, then it could take him a lot more time.

 

About the complications, I think if both of you are clear that applying for Citizenship should not be done only to speed up the process, but also because you have a bond with the US that you would like it to transcend, I don't know a lot about the Naturalization process, but I think if your interview feels that the Immigration process is the only reason, I don't think he/she could get it to influence negatively against your case.

 

However, I would recommend that you wait for responses from people with experience on this area.

May 10, 2018: I-130 Approved  :D *But case sent to NVC*

July 11: INFOPASS Appt + Sent Additional Documents

July 20: Case Ready for Interview (Finally!)

August 14: Card being produced //  August 22: Combo Card in hand

Thanks! No, he definitely wants to be a citizen, he becomes more American all the time lol...and I love to tease him about it. It's just something that we've put off because of the money (there is always something else that comes up that we need to take care of) but he got a new job last Sept and makes really good money now so it won't be as much of an issue. So it looks like we'll go that way...file the I-130 and then apply for his citizenship. I really appreciate your help!

You file for him as a step parent, takes a year or so.

Actually Boiler is right, I didn't know you were a citizen, but you can apply for his son as a step-parent, the important limitation there would have been that your marriage would have to be before his son was 18 years old, and by your signature, I noticed it was before that. Actually that could be a faster process, and safer because you guys would have to wait for the Citizenship, or rely that USCIS would timely upgrade the petition from son of a Permanent Resident to son of a USC. In the end it could be the same 2 documents N-400 for your husband, and I-130, but petitioned by you instead of him, now both cases would be clearer and a lot less complications could occur.
