It's possible to obtain a tourist visa while waiting for the I-129F or K-1 visa approval, but highly unlikely to actually occur.

If somebody already has a tourist visa (or can use an ESTA), that's a different matter...generally they shouldn't have an issue visiting using their existing travel document.

I applied for the tourist visa B2 just after filling the K-1 on March, 6. The lawyer advise me not to travel with my ESTA. I had my interview at the embassy and everything was fine. Just visit my boyfriend the first week of April. So you do not lose anything trying and most cases I read they got their tourist visa. It is true that the lawyer told me better to use it for short vacations like máximum 3 weeks.

It is certainly possible to reapply. There is nothing preventing you from applying again. But, as you already know, applying does not guarantee an approval. There is a slim possibility that after a denial of tourist visa AND a K1 visa case currently in progress, you can get a tourist visa. But those odds are too high, imho.

 

Stay strong and don't let the long wait and distance sway you. If you look at the end result, a few more months of separation is worth a lifetime with your loved one.

Does this apply to both the petitioner and the beneficiary? Or more to the beneficiary?

The petitioner is a USC for an I-129F, so there's no need for a US visa...?

If you're asking about the petitioner obtaining a visa to travel to another country, then unfortunately I can't be of much help there. Travel privileges to a foreign country fall under the laws of that country. The US is generally pretty strict with tourist visas, whereas most other countries tend not to scrutinize a USC in the same way, but the specific country involved and their laws and procedures matter.

Yes, I'm quite aware of that.

 

And yes, I did mean for the petitioner obtaining a travel visa to the country of the beneficiary. I wasn't sure if any more scrutiny was placed on them or if it needs to be disclosed in the first place. Just curious if anyone already had that information handy.

I think that depends on the county’s laws and politics. I go to El Salvador for 1-2 weeks every month and they don’t seem to give a lick.

A september filer passing by here. I'm the beneficiary from Russia, as you can see. My fiancée got a Russian tourist visa in March with no problems and is coming here in May. Hopefully her entry will be smooth. I don't really think an USC is gonna have troubles obtaining a visa..

I think that depends on the county’s laws and politics. I go to El Salvador for 1-2 weeks every month and they don’t seem to give a lick.

I came back from NYC last week and I travelled under the VWP and had no issues at all they didn’t even mention it. Hope that helps :)

Charts to compare July, August, September and October regarding the length of time from Received to Approved (as to 05/06/2018).

 

As a reminder, in the charts below I try to compare what happened within the next 187 days after the last day of July, August, September and October received cases. In order to see them clearer I put them together in pairs.

 

In that time, with a total of 596, 849, 923 and 1038 approved cases respectively:

 

  • July had a global mean of 195.56 days from Received to Approval date, with a standard deviation of 5.22 days.
  • August had a global mean of 189.94 days from Received to Approval date, with a standard deviation of 6.95 days.
  • September had a global mean of 187.57 days from Received to Approval date, with a standard deviation of 7.68 days.
  • October had a global mean of 182.92 days from Received to Approval date, with a standard deviation of 7.00 days.

 

As I mentioned in some previous post there clearly was a turning point from July to August, and it has kept improving consistently ever since. Notice that they did not only shortened the average number of days, they also approved more cases in the same period of time. Hopefully this tendency will continue! :)
