hello everyone,

 

i would just like to update everyone on our status. so today when i called nvc they just created a case number for us. the lady said now they will send our petition to ciudad juarez. will i also get something in my email or the mail?

I probably should've asked about this before submitting the i-129f. I received an RFE for answering yes to the "Have you ever been arrested, cited..." question. They want police records. I answered yes because my parents were fined $50 when I broke curfew at age 16. The RFE says that my "criminal conviction will be provided to the beneficiary", but it wasn't even a criminal conviction. So I'll have to let her know when I talk with her next time. 

 

I wanted to avoid getting my application denied by including more detail, but now I feel like I shouldn't have mentioned it at all. 

Application Submitted: March 16, 2018.

Case Approved: November 19, 2018.

This process is not taken lightly by USCIS. You misrepresent the truth and you are DENIED and with a possibility of being BANNED. I'm sure you want neither. ALWAYS tell the truth and you shouldn't have any problems.

I failed to mention a 30 year old misdemeanor arrest that was dropped and later expunged.  It was my fault and partially the fault of the company we used to help with the petition.  The governments instructions were very clear.  The company we used was not as clear as they should have been.  Since there are no public records and no possibility of me getting any information, I assumed it was no longer an impediment.  The expungement ordered all records, digital and hard, to be destroyed.  There was no record that I could produce so I failed to add it to the petition.  That was my mistake and we were denied because of the petitioner failing to disclose information in the petition.

I did a little more investigation on this topic and you were right. The changes are now permanent that were only talked about just recently. I have changed my instructions for USEM in the Philippines to reflect those changes. Thank you for the heads up.

If you received the NVC letter through mail or email, do a photocopies because they will get that copies for paying the visa and also for medical and just in case, 

 

And if your case status is already READY you can print out that too if you can’t wait for your hard copy of NVC or through email. That’s what I watched and asked the K1 Visa processer experienced.

They will but only to the beneficiary that will be included in the packet 3.

Total of 222 days....its been 10 days of our RFE response recieved by USCIS...still no updates about anything....:(

This is really testing patience...how long it wud hav taken to look at the passport photo we sent in reply fr thr RFE which was jus issued for  passport photo of petitioner... I really dnt know wats going on ...😞

Ah ok. So you’ll be getting an email(don’t forget to give your email address to NVC) notification as soon as they forwarded your case to your local embassy.

233 total; 21 since RFE response for us. They keep telling me it will take up to 60 days from receiving the response to get an action. Tier1 submitted an "outside of processing time request" for us last week  in which we got an email that said it will take up to 45 days for an action. So basically 60 days. No choice but to wait it out.

 

Asking my congressmen is not an option since I live in the good ol' red as can be state of Texas; our congressmen will have no interest in helping a gay couple with immigration. 🙄
