My grandfather used to say "everything comes out in the wash"  If there is something else, it will come out! I know my fiancé have established and have a very strong relationship built on trust. But I also work as a data analyst and believe in validation. I have the time and the resources to drag this out to conclusion.I'm too young to retire but I enjoy traveling so I guess I will travel more until I can settle down with my wife. Personally I feel that if the US Embassy denied because they had inconclusive allegations and this denial reason is a "catch all" when they don't want to approve because it's tainted.

While the reason stated for the refusal is completely at the CO's discretion, they do not do it just for the heck of it either. And as stated, it goes through a supervisor as well. I have no idea what triggered the heavy scrutiny though, sorry. It's very unusual for USEM.

 

What will happen next (assuming the refusal is final...i.e. reviewed by the supervisor and all) is the petition will be sent back to NVC and then to USCIS with a recommendation to revoke it. USCIS does not review returned I-129Fs anymore, so it will sit to expire. You can refile for a K-1 - or preferably marry and do a CR-1 - at any time. However, you may want to send a FOIA request to see what happened with the old one, and find out any specific reasons for recommending that the petition be revoked by the CO.

 

If the case has not yet been reviewed and returned to the US, you can seek out a congressman to inquire on your behalf, and hopefully hear something back.

Thanks for the info, I knew about the "FOIA" and intend to get that prior to any additional proceedings. My US Senator has been informed and hopefully can get a reversal before the paperwork is sent back. 

I appreciate your best wishes, my attitude is this.We have our health and success. We have been through a lot but we are very fortunate and thankful for everything.

An update with some inside information. Most of you that said an Ex trying to impede the K1 with aligations is not enough. You are correct, US Embassy gets this type of stuff all the time. The difference is or the reason for extra scrutiny and denial is, my fiancé is from Mindinao and from an area that is under watch. This is, per my insider the bigger picture that the US Embassy is looking at. 

As a former combat vet. I completely agree with any effort to screen out people from questionable regions.

I totally agree with you on this. Trust me my ex-wife tried to do the same to me after we got divorced. She was still mad that she didn't get half of the house I got inherited the year before we divorced. It's not my fault she couldn't figure out what a Absolute Divorce meant in NC and she had a certain amount of time to challenge it before it went back to court, then we were officially divorced.

As others and myself have said on here before that something is not right AT ALL in this case and you need to get to the bottom of it. My then fiancé now wife is from Mindanao as well and we had absolutely no problem at all so that shouldn't be case why she got denied. You NEED to figure what happened before you go off and get married then file the CR-1.

 

Where in Mindanao is she from if you don't mind me asking? Former Marine Combat Vet here as well. Who did you serve with?

Thanks to the FIOA. I will be getting all the info prior to CR1. She's from Lanao De Norte, and last year it was pretty hot in that zone. I'm a former combat medic snd I proudly served in the USAF. I wasn't a PJ but I was part of the SAC forces out of March AFB. BTW thanks for serving, my dad was  USMC Force Recon. All Marines are Bad ###!!

Has your fiancé been married before? Not sure how long you guys have been in relationship together or how long ago since you met her. You mentioned about your fiancé is very pretty so I could be assuming that she could have met some other guys in the past  before she met you. Maybe this guy could also be from Mindanao and it's being scrutinized closely. There has to be a reason for the K1 denial.
