So where is the guy who posted this topic asking why they were denied? He got quiet all of a sudden and didn't respond to let us know the evidence of relationship he submitted to USCIS. Coz 5 times visit to the Philippines means visiting the country or business trip. Obviously there is something more to the story ;)

I wouldn't do another K1.  From what i see now of days.  Fiance and Spousal visa are taking about the same time, so in the end it would be cheaper and easier to just do the spousal visa.  You will have to deal with the BS rules for getting married in Philippines, but other than that seems like your best option.

They asked about her friends on social media and 1 guy that visited her 8 years before I met her. I was kinda weird but I know my Ex was stalking her on FB and must have made false allegations to the Embassy.

typical photo album/scrap book and all sponsorship stuff. They never asked and to look through the packet and seemed to rush through it.

K-1

    More expensive than CR-1

    Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)

    Spouse can not leave the US until she receives approved Advance Parole (approx 3-4 months)

    Spouse can not work until she receives EAD (approx 3-4 months)

    some people have had problems with driver licenses, Social Security cards, leases, bank account during this period .

    Spouse will not receive Green Card for many months after Adjustment of Status is filed.

CR-1

    Less expensive than K-1

    No AOS required.

    Spouse can immediately travel outside the US

    Spouse can start work if desired

    Spouse receives Social Security Card and Green Card withing 2 or 3 weeks after entering the US

    Spouse  has legal permanent Resident status IMMEDIATELY upon entry to US. 

 

All-in-all, the CR-1 is superior to the K-1 imo.

   

That is now. When my now hubby applied for my  k1, it used to take 3-6 months to get it and the price was no different as for the cr1 you needed to pay for the 130 plus Green card, and the cr1 took almost 8-11 months. 

The ead used to take less than 60 days. I met a couple who got their entire k1 approved in 2 months. Mine was 3 months for noa2 and a total of 6 months.

 

back then the k1 visa was the best and fastest option even if you had to go through aos, at least the couples were together.

 

nowdays it doesn’t make any sense to apply for k1

Please upload the full letter into this thread as an attachment----remove all personal names, etc.----it will give us a better idea of exactly why you were denied (being able to see USCIS's wording in the letter), and we can then help you with how to overcome it, if able to, to avoid the same issue in the future....it doesn't make much sense that you were denied for the reasons you are stating.

Oh come on. You don’t even believe it yourself that the embassy would take any notice of idle gossip from a jealous ex.

All seems very odd.  Manila has an insanely high approval rate.  And this is the first time I can recall them asking anything about social media stuff.  It does seem as though the Embassy has some kind of knowledge about her.  You clearly proved a relationship, they just didn't believe it for whatever reason.  In their eyes, would getting married and applying for the CR1 make them believe anything further?  Normally, I would say yes, but this is a strange case.  I would lawyer up asap.

I know what venom of lies and rumors my ex has done to my friends and family about my fiancé and I. They have forwarded to me. That is the reason for my suspicions. 

As for the denial verbatim it has the x check next to this type form statement “It was not established that the beneficiary and petitioner have a bona  fide relationship.”

I have heard from an attorney that this the denial reason commonly used when the agent wants to deny without any clear causes. As for knowing my fiancé and ever doughting her honest loyalty and transparency to me. That is not ever been considered a question in my mind. I know everything about her past and present. The agent even stated to her, your a very attractive girl, many men must have interest in you. What the hell? He also said, your man seems very fit, what hobbies does he do, he has also come to visit you many times. There was no attempt to ask her to withdraw the application he just closed by saying he supports the application but this needs to be reviewed before approval. When I had not heard anything after 2 months and a 2 phone calls I contacted my US Senator that is a friend of my company owners so the US Embassy was contact by their office about the delay along with my letter describing the establishment of our relationship. So in hindsight I may have pissed someone off but I could not sit idle or allow this to pend. At least now I can work on plan B

I'm sorry if you already answered this, but could you please let us know what type of documents you provided: hotel/lodging receipts, flight stubs, photographs, etc for EACH and every visit? Or did you just supply them for the first visit? Did you supply letters from family and friends? Any more information you can give? I think it would be very helpful for a lot of us if you'd be very specify please :)

To be honest, we didn't provide every hotel receipt or flight stubs for each and every visit, just some of the most recent and a few of the random first trips. No letters from family and friends(That's a good idea). But my fiancé said the first interview was very rushed and then the second interview the agent looked through all that we provided.

I'm sure you are aware that for a K-1, you only have to show evidence of meeting one in the previous 2 years....i think you met that burden of proof handily.  There must be something else....and I suspect your fiance has the key......i wish you well.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That's for the I-129F. For the K-1, you must show evidence of a bona fide relationship. Showing time together face-to-face helps.

 

But yes....there's something else going on here. It's incredibly out of the norm for USEM to refuse a K-1 visa on relationship grounds with that much evidence provided. And I don't think it's just some nasty CO as refusals go through supervisor review, and they had a second interview even.
