Hi,

I am an unemployed and married petitioner, Who files joint taxes with my husband.

I have a stepson that doesn't live with us nor do we claim him on our taxes, but my husband supports him financially.  

I am filing for my mom and is now preparing the I-864.

 

Q1:  Do I have to include my stepson in household size on my 1-864?

If I have to include him then our income would not be enough to cover my mom, so I would use my aunt as my joint sponsor.

 

Q2: If I use my aunt, what do I do about tax returns, since my husband is the only income and we file jointly?

Do I still put his income in total household income and submit our joint tax return to show that I filed taxes?

  If the child is under 18 you report him , if the child is over 18 no.  Under 18 he is still a dependent even if he isn't living with you and you don't get the deduction ( usually the parent with the most physical custody gets it)   Once a child is over 18 continued support is optional.  Under 18 you are required to care for the child. 

This will not be over quickly. You will not enjoy this.

  You  will always be the primary sponsor , even if you only make $1    So you file the I 864 for your household with both incomes and your aunt files one that reflects her income and , dependants

My husband is in the military. Should I include his basic housing allowance (BHA) in household income on I-864?  it is not ever included in tax returns so iI may have to send his pay stub if it is included
