I am planning to visit Mexico in couple weeks with expired green card and I-797 NOA extending the GC by 18 months. Does anyone see a problem? Should I get an infopass to stamp I-551 instead?

@BR751

There have been multiple reports on other threads that the Mexican Immigration does not recognize I-797 extension letter as a valid proof of permanent resident.  I personally have travelled with I-551 stamp in my passport and I did not have any issue at all.  The link below is from the Mexican Consulate in Boston where I live.

https://consulmex.sre.gob.mx/boston/index.php/consular-services/62-visas-ingles

It does not explicitly say that I-797 is not acceptable, but it does say this:

To enter as tourists or for any non-paid activity for up to 180 days, Citizens of the aforementioned countries should bear their valid passports and foreigners should bear their valid passports and, depending on their specific case, a valid permanent resident card or a valid visa (any type) of the above mentioned countries, stamped on their passports.

Note that Mexico also accepts a valid visa (any type) of the United States, Canada, Japan, United Kingdom or any country of the Schengen Area stamped on your passport.

So if you have any of these other visas listed, you can use that as alternative to enter Mexico.  Your expired green card plus an I-797 extension letter will be accepted as a proof of return to the United States (that is not an issue).

Alternatively, you can also apply for a Mexican tourist visa.  It is only $36 and it surely will give you peace of mind (assuming that you don't have any other visa other than US green card).  It is really easy and fast.  It is pretty much a one day process where I live.

Hope this help

@BR751  What's your home country? if you are planning to visit Mexico you have to check if you need a visa. Your expired GC and I-797 is not valid to enter Mexico. Some officers won't recognize the extension.   " If the U.S.A visa stamped in your passport is already expired but you have an official document or form proving your legal status in USA, you should apply for a Mexican visa at this Consulate (I-797 A Forms, Advance Parole Forms, I-20 OR DS-2019 Forms won’t be good enough for entering into Mexico without a Mexican visa). "  https://consulmex.sre.gob.mx/losangeles/

I went to the Mexican consulate and had my Mexican Visa 2 weeks ago i just paid $36. Check the requirements on the website.

Congratulations!

********

I called the 1-800 number and found out that my case was transferred to Mesquite, TX.

I don't know if it's good or bad but I'll just keep waiting. Haven't file for N-400. I will wait till I get my 10 year GC first.

I also read about workload transferring cases and it states "If we transfer your case, we will send you a transfer notice. Your receipt number will not change, and the transfer will not delay the processing of your case."

Good luck!

Hey all,

I tried checking the status of my file online and its saying cannot find information at this time. I then called the 1-800 number and the automated system is saying they have no information on my receipt #. Should I be worried? I'm worried! I filed on March 6th, 2018.

@Rickey&Char call the 800 number again and talk to a live person. They don't update mine as well. They just send the approval and GC.

Thanks! After a 30min wait, they said a RFE was mailed to me yesterday but can't tell me what is required so I guess it's time to wait on the mailman 😕
