Hello.

 

I need someone's advise who experienced same situation as me. 

I applied for I-765 (Employment Authorization) last September with I-485 and I-131. I received an letter saying they received my paper work on October 2nd, 2017.

 

Now, it has been almost Five months! I am really worry whether my paper got lost or had any issues like missing information or something. But I haven't received any e-mail or letter from them.

I checked other people's status and many people who submit their paper after November, 2017 got approval already... 

 

I called USCIS today and the lady I spoke to said she is going to send 'service request '. Whats worse is my husband has government health insurance and I was able to join his health insurance from this January but  I was told that they are going to remove me next week unless I show them 'proof of legal status' . I showed them a letter I received but they said they need EAD

 

Please share your story if you went through similar situation as me. Or how long it took you to get EAD:cry:

The NOA 1 from your AOS filing should be silufficient as prove that you are adjusting status and legally here.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

It currently can take 5-6 months for most to receive the EAD. You could have tried to expedite it with a job offer based on financial hardship
after 75 days.

I submit my NOA 1 as my proof of legal status but they let me join the health insurance only for three month and now they are asking me to submit EAD or Green card or they are going to remove me from the plan next week. :(

 

It takes 5-6 months to receive EAD these days? That's good to know! I am relief a little bit since I thought I am only one in the world that taking so long to receive EAD

I really need to work soon since I'm keep spending money from my savings since last May and I'm scared that all my money is gonna be gone. :crying:

Sorry you have to deal with this Anne, rest assured your documents aren't lost. You should have the card within the next 6 weeks I am guessing. You could try contacting your congress person and asking them to ask USCIS on your behalf.

I filed in August. After 203 days, my EAD is finally in production. Service requests are useless and don't help. I would recommend contacting your Congressperson or the Ombudsman - or both. 

August 2017 - June 2018 AoS

April 2020 - January 2021 RoC

Jan 2022 - September 2022 Citizenship

I'm sorry but who do you mean congress person? A lawyer?

It is very unfair that the government has allowed the waiting period to get this long, the other services that people really need are not set up to accommodate a legal person who is in limbo this long.  

 

Your congressman office, I contacted mine and filled out a form with some information and they asked USCIS themselves what was going on. I got my card about a week after that (might have been a coincidence but it can't hurt to try).

At least I know I was not the only one who's waiting for over five month to get EAD

I don't know my congress person so I gotta figure it out.

Google who the senator is in your state (there are 2) and go to his web site, call their office and sign a privacy release so they can contact USCIS
on your behalf.

Well, I haven't actually gotten the EAD in my hands yet, but it's finally on the way! 

 

I'd recommend filling out the Ombudsman form as well.. it's really easy, everything is online (including the privacy release), and at least then you've started the process with one place. 

 

August 2017 - June 2018 AoS

April 2020 - January 2021 RoC

Jan 2022 - September 2022 Citizenship

I applied on 9th August 2017 and I got my card on 8th January 2018.

 

I tried everything to get it pushed through quicker - service requests, expedite requests and contacting my local senator. Nothing worked. That's not to say you shouldn't try. I found I slept slightly better at night knowing I had exhausted all the options available.

 

Also, I applied for my Green Card at the same time as my EAD and I've been told that they are currently processing January 2017 which means its still a while away. But honestly, who knows. I take what the frontline staff at USCIS say with a grain of salt after being told conflicting information on numerous occasions.
