word fraud in annulment

Hello everyone

 

I married to my wife 5  years ago  I apply for green card for her, after  first interview , they told us will call us for another interview , its been 5 years since than we did not hear from them

 

she was married back in 2005  but the marriage did not completed and was issue her annulment  in new York that state fraud annulment as she was under lot of stress se sign it not knowing what she sign till now.

that marriage was never fraud , hes mother refuse her son to married due to there culture he have to married some one from hes own .

 

When I apply for my wife , we found that her EX husband file for her at that time and case was active, the officer at the interview close that case than and told us that they will call us .

 

please advice if someone in same situation

By signing that statement, she was agreeing that her previous marriage was entered into by her under fraud?

Is she still in the US now?

yes I understand she was 23 years at that time , don't know any better but just to get out of bad relation , and she was under depression

Whether it was truly fraud or not---she went ahead and signed the statement saying it WAS.  They will most likely assume your marriage was entered into under fraud by her, too, unfortunately, unless you both provided hard evidence showing otherwise.

Why haven't you followed up with your case for over 5 years?  Perhaps a good idea to reach out to USCIS....only they will be able to tell you what's going on.
