When do I send in the I-134, Affadavit of Support?

Recommended Posts

The I-134 is presented at the embassy interview by the beneficiary. The information on it would be out of date if you sent it with the I-129F anyway.

Weirdly enough, my fiancée had it sent with the I-129F too. I am confused about this as well.

 

My fiancée is extremely convinced that it is one of the required forms that he needed to submit along with the I-129F. He did the petition on his own. The US-consulate in Singapore is saying that the I-129F is one of the documents I have to bring to the interview.

 

The answers I read from VisaJourney ranges from sent along with the I-129F or only need at the interview. Some even say that if it is sent with the I-129F, I do not need to present it during the interview.

 

My fiancée is going to fill out a new one to reflect his new income, as well as sign another copy of the old one he submitted with the I-129F to give to me, just to ease my mind.

 

If this piece if information helps: we got approved, no RFEs, on 16th or 21st February. NOA1 was 28th July. USCIS did return my fiancée's certified copy of birth certificate, but did not return the I-129F.

I'm sorry, I totally just realized that I wrote a typo there and I can't edit my post so, what I meant was USCIS did not return the AOS my fiancée sent with the I-129F petition, with the birth certificate that they returned.

 

Of course they don't return the petition to us. *smacks face* :bonk:

It's not required with the I-129F. I have no idea where on VJ you read that it is required with the I-129F...can you point me at anything?

 

Check the I-129F instructions, the checklist that goes alongside the I-129F (m-1151), the guides here on VJ, etc. It's certainly not a required document, and - given the current processing timelines - is not useful for the embassy either. Maybe it made more sense back when processing times for the I-129F was a couple months, in which case it might still be accepted by the CO. But a new, more recent I-134 would still be suggested.

Again, they did not return the AOS along with the birth certificate to my fiancé. They don't throw these papers, they send them to NVC then to the US consulate.

 

And I don't know, love. I've read so many posts on VJ and other US immigration sites, and these things that I read really might even be from posts of years ago. I really never bothered to note them and I don't want to find them again because I've already made a conclusion to provide AOS during the interview.

 

All I knew then while I was searching through these posts was that my fiancée asked me why I demanded he sign me a new AOS if he has already submitted one to USCIS. I told him because the list the US Embassy in Singapore provided said so and Naes said so too and I trust Naes. When I asked Naes, she said that we only provide the AOS during the interview.

 

Went back to my fiancé, he said he already sent it to USCIS. In the end, I'm taking the safe route and demanding my Baby signs me new copies.

 

Don't be mad at me, ok. I have to do a lot of differently. :cry: I even have to complete the DS-260, not DS-160, info courtesy of the US consulate here. I'm just sharing my experiences.

That's normal. USCIS will not consider the I-134 at all, so they will just ignore it. They won't send it back...they will send the entire packet to NVC then the consulate (as you noted).

I'm not sure why they sent the BC back...maybe it was an original instead of a copy?

Mad? No no no....I'm not mad at all. I certainly did not intend for my post to come off as such.

 

You will need to complete a DS-160 for a K-1 visa. This is not embassy-specific. Most likely the website copied/pasted the immigrant visa instructions since the K-1 is handled by the immigrant visa unit at the embassy. But nobody completes a DS-260 for a K-1 visa.

Wells. See, every case is super unique... I mean... What do you mean by he sent his I-134 with his I-129F to the Embassy in LAOS... Wasn't he suppose to send it to USCIS...?

 

Nevermind, cancel that thought. Just. Now is now.

 

geowrian says beneficiary just needs to bring I-134 to the interview. I say sending it with the I-129F to USCIS has no harm. :3

I sent mine with the packet but

 

I had to provide all  the updated information (updated employer letter, patstubs, etc) at the interview. I happened to be visiting my now husband at the time so I just brought it all with me.

 

My husband said they took all that information from our binder to review and keep. I believe it is most important to have it all up to date at the interview from our experience.

 

 I read some people were being required to bring this updated information (or their case was on hold until they provided updated paperwork) when their interview took more than 6 months from filing. I went through the process one year ago.
